An ordinance granting t Frank Busch, his heirs and assigns, the right to take water from Singer Hill creek and to conduct the same along and under certain streets of Oregon City to the easterly line of Block No. 23 of Oregon City, Oregon, for manufac turing purposes. Oregon City does ordain as follows: Section 1. That there be and is hereby granted to Frank Busch, his heirs and assigns, the right and au thority to take water from the creek commonly known as the Singer Hill creek at a point on Seventh street of Oregon City, between Center street and the top of the Bluff, and to con duct the same by pipe or flume along and under Seventh street and down the Bluff to the easterly line of Block No. 23, of Oregon City, Oregon, for the purpose of using the said water for the propulsion of machinery for the manufacture of furniture and other articles of trade or commerce, provided, however, that said right Is granted upon the following terms and conditions: 1. That the said Frank Buscb, bis heirs or assigns, shall be held respon sible for all damage that may occur to Oregon City or to any individual owner of property within Oregon City by reason of any leakage, overflow or breaking away of the water so con ducted along and under said street and down said Bluff. 2. That the pipe or flume by which said water may be conveyed shall be safely covered over with due dili gence while in course of construction, and when completed shall be made se cure for the crossing of persons, hors es, cattle and wagons over and upon said Seventh street and at any point along said pipe or flume where Oregon City may bareafter construct a street or roadway. That the streets and side walks along and over said pipe or flume shall after the construction thereof be left In as Rood coudltton as they now are or may be when the work of construction Is bemm And If the parties in Interest under this Kraut of a right of way tail to make any repairs to said pipe or flume which may become necessary to He- cure the public in the use of any thor- oushfar along which water may be taken, they shall forfeit all rights and privileges under this ordinance, and shall be liable for all damage which may result because of such neglect. 3. Any person or company may hereafter be granted the right by the Council to bring down a larger supply of water in a pipe or Hume of in creased capacity and way enter upou and use the ground or space occupied by the parties in interest hereunder, provided said person or compauy guarantee to the parties in Interest hereunder, a flow of water equal to the maximum quantity ow ued by them and being responsible In actual dam ages to said parties in Interest here under for all delay or stoppage of water already In use by them. 0. It is provided that if any person or company shall here after make ap plication to enter and occupy the ground already in use by the parties in Interest hereunder, the last person or company shall be held responsible for all damages that may occur by reason of any leakage, overflow or breaking away of their pipe or flume. Section 2. The said brans Uusen. his heirs or assigns, shall pay annual ly in advance to Oregon City as a license for the privileges herein grant ed the sum of $10 00 per annum in ad vance, and a failure to so pay said li cense shall work a forfeiture of all rights granted hereunder. Section 3. All rights and privi leges hereby grunted shall expire at the end of "thirty years from the date of the approval of this ordinance. Section 4. This ordinance shall not take effect unless a written accept ance ot tne terms and comiKton.4 thereof shall be tiled in the office of the Recorder of Oregon City within thirty days after the approval of this ordinance. Section 5. That said Frank Busch. his heirs and assigns, shall be deemed to have abandoned all rights ami priv ileges conferred by this ordinance, unless he or they shall within one year from the approval of this ordi nance, construct said pipe or flume herein provided for.
