Marks, Elokard In the matter of the petition of F. L. Rags, et al, for a county road, the view ers reported favorably, the petition was granted and viewers and surveror's ex penses ordered paid. In the matter of the petition of F. P. Larson, et al, for county road, J. H. Smith appointed surveyor, and C A Miller, Henry Oana and J S Kisley, Tiewers. In the matter of petition of School Dist No. 8 against the remission of the taxes on the Clayson estate. It was ordered that attorneys for estate to ap pear at October term of court, and show why an order rescinding an order reduc ing the taxes of said estate should not be made. In the matter of the petition of W II Burghanlt, spent, for a motor franchise on the Molalla and Highland road, the same was granted. "This matter coming on regularly to be heard, and it appearing to the court that said petition should be granted, and all things being by the court considered. "It is ordered that there be and there is hereby granted unto W. II. Burg hardt, ip'nt, and his assigns, the right and privilege to lay down, maintain and operate iron and steel railway tracks, and to erect poles and appliances and st i etch wires thereon for the purpose of transmitting power, to be used in operat ing said railway by electric power ujon the roads of CUrkumaa county as follow : "Beginning at the intersection of Sev enth street, Oreiron City, with Slolalla avenue ; thence along the west side of Molulla avenue to junction of Molalla and Highland roads ; thence along the vest side of said Highland road to a point 1 St 0 feet south of south pier of what is known as the Latourette bridge. "The track of said railway shall be a single one wiih necessary turnouts and turntables and shall be laid and the poles erected for the purposes hereinbe fore specified along the westerly Bide of said roads and within a line 16 feet from the westerly side of said roads according to the surveys thereof, which space is hereby granted to said W. II. Burg hardt, agent, and to his assigns as a right of way for the purposes of said railway; said road to be placed upon adopted grades, excepting where spec ially agreed npon between this court and the eaid Purghardt, agent, or Lis as signs, fruin road abutting property . "Xo right is granted to use any coun ty bridge or cui verts. "The track over said right of way shall be completed within two years from the date of this order, and work shall be commenced ucon the said right of way for the purpose of preparing it for the eaid tracks and poles within one year from the date beieof. "The right is reserved by the county court to make necessary orders or rules to regulate the running of trair.s on and over the roads of Clackamas county that may be necessary for the convenience and safety ol the public. "All tights and privileges hereby con ferred shall expire at the end of 50 years from the date of this order, or upon fail tire to comply with any of the provisions of this franchise. ".Said W. II. Burghardt, agent, or his assigns, shall within two years from (he date of this order and thereafter during the term of this franchise, operate cars upon saiJ railway at least once each day in each direction, over the entire right of way hcre'.ry granted, and a failure to operate said cars for more than 100 days in any one year shall work a forfeiture of this franchise. "A failure on the part of fcaid W. II. Burghardt, agent, or his assigns, to com ply with any of the provisions of the franchise shall work a forfeiture of all rights and privileges hereby conferred," Also, under the same conditions: "Beginning at a point on west side of Highland road, J800 feet south of the south pier of what is known as Latour ette bridge; thence along the west side of Highland road to where the north and south one-half section line of section 22, township 3 south, range 2 east, intersects eaid Highland road." In the matter of plank on the High land road, it was ordered that contract be fulfilled, and that payment for same come out of next years' apportionment of district No. 18. In the matter of bids for county phy sician and burial of county pauperB, the same was passed over. The supervisor's bond of district No. 28 approved, and the supervisor was ordered to spend $33, on the main thoroughfare where most needed. In the matter of petition to refund $2.91, paid to the sheriff by John Ameter for taxes by mistake, the same was re ferred to shenI. The matter of examining the tax roll and making tax levy for lS'.KS, the snino was tcntiuuod until November. In the matter of bridges in district No. SS, the same was referred to Commis sioner Morton with power to act. In the matter of painting the roof of the court house, the same was referred to judge with power to act. In tho matter of the care and keeping of D Mortimer, It was ordered that Isaac Primlle be paid 20 (or keeping said Mortimer during the month of September. It was also ordered that E O Mortimer and Isaac Allison be cited to appear More the court and show cause why they should not support said D Mortimer. In the matter of raising the allowance of Mt and Mrs Ahle.it was ordered raised to $J0 per month, via: Septem ber and November, warrant to be drawn tn favor of Mrs. J-omlon. In the matter of aid for Mr and Mrs Ramsden and Hank Matton, the same was referred to Judge Kyaa w ith power to act. In the matter of Mrs Kunvan, county charge, relief was ordered con' lined until further orders. In the matter of delinquent tax sales (or 1N' , it was ordered that the county judge bid in all property not purchased by others. In the matter of a road of public ease ment for l'hoebe Sharp, viewers were appointed to meet on Sept 17, and view said road. In the matter of the proposition of II E Noble to collect delinquent taxes, it was ordered that court inform utile that the court had ordered county judge to Did in all property, not sold to others In the matter of repairing the haglo Creek and Currinsvtlle road, James Harden was appointed to repair the same and receive 13 per day for ma services In the matter of the report of O B Dimickon taxes collected on tho Clayson estate, the same was laid over until next term. In the matter of reports of fees col locted by clerk and recorder for the month of August, the same was approved as follows: Recorder, 12oM5; clerk, The report of the sheriff in the matter of collection of taxes for the year 1897, coming on to be heard, and it appearing that he had collected $39,038,03, on acconnt of said taxes, also claiming credits on account of errors and double assess ments In the amount of $319.29 and by amount returned on delinquent tax roll of $10,40(1 75. It is hereby Ordered that the sheriff he credited with the amount of $39,938 03 and that said report be filed to come up for further examination and approved at November term of this court.
