Rees; the motion of plaintiff for a new trial was denied, and it was oidered and ad judged and decreed that said defendants rex-over from said plaint iff their costs and disbursements incurred in this action, amounting to the sum of f-'S.Co, and that the attachment herein be dismissed, and that plaintiffs have till Jan. 27, lS'.Hi, to file bill of exceptions. Capen Shoe Company vs James Ogle and Henry Warnock ; on motion of Franklin T. Griffifth, attorney for plain tiff, it is ordered and adjudged that plaintiff do have and recover of and from the said defendants the sum of J88.S5 with interest and costs and dis bursements, taxed at $12. Charles Moenke vs Joseph Rue; the court decides that by reason of said lien failing to state the name of the true owner of said property, no lien attached to said lot or the building situated thereen, it is therefore ordered that plaintiff's 'suit be dismissed and that neither party recover costs and disburse ments. tT. L. Charman vs V. L. Snidow and A. W. Schwan; the plaintiffs appeared .in person and by his attorneys, C. D. and D. C. Latourette, and the defend ants by Ira Jones, their attorney, as well as in person, and after hearing argu ment the court finds as follows: First, that the plaintiff is entitled to the im mediate possession of that strip of land lying opposite to blocks 8 and 9 on the westerly side thereof and between said blocks and the Willamette river in Ore gon City, as shown by the original map of said city. Second, that the said de fendants about the 9th of April, 1895, entered npon said premises and with held the same from plaintiff with furce. And as conclusions of law the court finds that the plaintiff is entitled to res titution of said premises; it is therefore considered and adjudged that the plain tiff have restitution of possession of Baid premises described, and that the plain tiff recover from defendant his costs and disbursements. The defendants are al lowed 30 days to file bill of exceptions.
