Evans and Morrull ire now behind the bars in the county jail, having iiirreniJered to Sheriff Kay todty. Negotiations between the officers and the bandits were carried on by letters delivered by Kvana young boy. Evans came In tliia morning, lie looki very rough and needed a bath. Morrell looked si'nous as though not apprecia ting his condition. Evans and his part ner had taken refuge in Evans' own houae, and as the officers had them cer tainly and exactly located, the preniiwa were closely hemmed with guards, and a peaceful surrender, or a desperate and bloody fight were two apparent contin gencies, the Utter, of course, being con sidered the moot likely to hapien. At 9 :15 A. M. a meaaenger was sent to the bouae with a note from Sheriff Kay and another from a Catholic priest, ad viHing them to surrender to gave lite, as their capture was certain. The outlaws detained the meiiaengcr as a hostage. The bouae is small, only two roome, and esaily commanded by the officers. After waiting an hour for the return of Beaaon, the mesaenger who was sent in with notes to Evans and Morrell aeklng foi their surrender, it became evident that be was held as a hostage, and the posse clotted up, waiting for further develop ments. At 10 o'clock Evans sent out a child with a note tor Hheriff Kay, aHkin htm to come into the bouxe lor consulta tion. It was then ascertained definitely from the child that one wuuien ami some children were in the huse besides the hostage they held. After an exchange of several notes between - Evans and Sheriff Kay, they finally agreed" td roine out if the officers would be inslrucled not to shoot, and the lare crowd of people who had gathered to witness the afTsir were sent back. . . 1 - At 10 :40 the door of Evans' cabin opened and Morn-It apeured and held up hit: hat ds, fwllowud immediately by EvanS without amiB. They were imme diately covered by twenty rifles and Sheriff Ksy and Marshl Gard advan ced and shook bands with Evam. A delivery wagou was pressed into service and they were driven rapidly to h!1. Iteason, the man who was captured and held as a hostage, is an old friend of EvanB. He says that when he rapped at the door of the cabin, Evans appeared with a gun in his hand, and after he ascertained who wanted admittance, jerked him into the cabin and immedi ately slammed and jerked the door. He then had Reason tell him the exact sit uation on the outside and asked his ad vice. Beaaon told him the whole coun try was aroused, that hundreds of men armed with shotguns, rifles and revolve is were concealed behind every fence, out building and point of of vantHge, and it was impossible for them to escape, f hey were only waiting for the women and children to be removed to make an attack on the house. Fina'.ly Evans concluded it would be impoeeible to escape, and, making a virtue of neces sity, surrendered. Evans looks very thin and pale, as though he had passed through a severe spell of sickness. There is great rejoic ing here at the capture, as many persons had reason to fear his vengeance for giving infornmtioii to officers, and there was a general belief that some valuable lives would be lost before he could lie captured. He is now safely lodged in the county jail, and it is safe to say will not be given any opportunity to escape. Feb. 20. Ktissell was short in his accounts, forged the name of Yost to cover bis shortage and is now under arrest at Bushnell, Mc Donough county, where he has wealthy and prominent relations. Democratic leaders of the house have under consider ation the following rule intended to dis courage the practice among republicans of refraining from voting on important measures, and compelling 'the democrats to produce a quorum: "Whoneverupon a rollcall a quorum fails to appear, upon the demand of any member the clerk shall certify a list of members not voting on such roll-call to the sargeant-at-arms, who shall deduct from the monthly com pensation of each member so failing to yote the amount of his salary for one day ; provided, this deduction shall not be made In case the member is absent by leave of the house," This rule simply carries ont the provisions of the law, which says the salary of members absent except on account of sickness, should be deducted during the time of absence. Heretofore, however, the sergeant-at-arms bad no way of officially ascertain ing the absence of any member. It is thought the bss ol pay for failure to vote will put a stop to the practice of refusing to respond when called to yote. TtUd for Eoal Baffraga Wasiiikmtok, Feb. 15. The others were biouyht be fore the bar of 1 the house and excused after giving a satisfactory explanation, and Bland renewed his siege. There publicans and Eastern democrats re newed Cilibustering breaking the quorum again by not voting, the vote standing 162 to 5, or 12 short of a quorum. Bapremt Court Bniineaa. Washington. Feb. 20. Justice White, the new member of the Bupreme coart, will be sworn in March 5, that being the first day of the spring term. He will at once be called upon to take part in the consideration of more important litigation than has greeted a new justice in many years. For many weeks the court has been anxiously awaiting full bench, and in the meantime important cases haye been fixed for hearing at such time as a new justice should take his place on the bench. These cases were finally set for March 5 in the hope that a nomination and confirmation might be made by that time. The records of the supreme court show accessions of Justice White It a.'es New York state without a representative in the court for the first time since 1306, the only exception since the court was established. Boitoa'i Unemployed Aik Aid. Boston, Feb. 20. 20 Five thousand unemployed made a demonstration on the common this afternoon which threat ened a riot. In an ugly mood they crowded into the statehouse and adjoin ing ground and demanded immediate aid. The governor addressed them from the statehouse. He was received with applause though he made no promises. An attempt was then made by the leader to get a petition before the legisla ture then in session. A large force of police was called out to guard against trouble. The leader tried to get into the legislative hall to present their griev ances while the crowd remained outside. Aaioolata Jaitica Confirmed. Washington, Feb. 15. Senator White of Louisiana, has been nominated by the president as associate justice of the United States supreme court. The nomination was a complete sur prise to everyone. Hill and the repub lican members who have been ques tioned say very little about White's con firmation as associate judge of the supreme court of the United States. In less than one hour after his name had been received by, the senate he had been confirmed.
