land Railway Light and Power Com
pany's railway track on Main street
In Oregon City, connecting with its
property In said city.
Oregon City does ordain as follows:
Section 1. That the right and priv
ilege Is hereby granted to the Hawley
Pulp and Paper Company to construct
and maintain switches, turn-outs, and
curves of Iron 6r steel railwaytrackg
to be constructed and maintained
In the manner hereinafter provided,
over the roads and streets, leading
from the Portland Railway Light .and
Power Company's tracks in Oregon
City, unto and upon the property of
the Hawley Pulp and Paper Company,
and to operate cars over the same as
follows:
First:
Beginning at a point on Third street,
71 feet Westerly from the Westerly
side line of Main street; thence run
ning from the track of the Portland
Railway Light and Power Company
by a curve to within 24 feet of the
Southerly line of Lot 5, Block 2, Ore
gon City, Oregon; thence Westerly
to the Willamette River.
Second ;
' Beginning at a pout, in the road, 34
feet Southerly of the Southerly line
of a certain concrete wall at the
Northerly end of what Is commonly
known as the Basin, where the same
crosses the Highway leading South
erly from Main Street; thence from
said Company's track on a curve
Northwesterly unto and upon the
property of the said Hawley Pulp and
Paper Company, Immediately North
of Bald basin.
Third;
Beginning at a point on said road
114 feet South of the said concrete
wall, thence running North Easterly
from the railway track of said Port
land Railway Light and Power Com
pany on a curve to the property of
said Hawley Pulp and Paper Com
pany, Immediately North of said con
crete wall.
Fourth;
Beginning at a point 120 feet south
of the said concrete wall and running
thence South Westerly to the afore
said basin.
Fifth;
Beginning at a point in the West
erly main track of the said Portland
Railway Light and Power Company
road on Main Street 25 feet Southerly
from a point opposite the center Hue
of the alley through block 29, thence
running South Easterly on a curve to
Lot 5, in said Block 29.
Section 2. Oregon City retains and
reserves to Itself the right to allow
any other company to use the tracks
laid down under this Ordinance, and
the right to fix the terms and condi
tions upon which such company shall
have the right to use and operate cars
upon said tracks, in the event of such
other company and the grantee herein
being unablo to agree.
Section 3. All tracks and rails laid
by virtue of the privileges granted
in this Ordinance, shall be of approv
ed design, and on Main street shall
be the same as that part of the Port
land Railway Light and Power Com
pany's track, where the connections
with said track are made, and shall
bo laid and constructed In the same
manner as the track and bed of the
said Portland Railway Light and Pow
er Company, along the portion of
Main Street, which such switch or
curve may traverse.
Section 4. The Hawley Pulp and
Paper Company, shall, at all times,
maintain that part of the street or
road-way between Its rails and one
foot on the outside of each rail In a
good slate of repair, and shall at all
times maintain the surface of said
street in such state of repair conform
ing to the established grade of said
street or road, and shall allow no cars
to stand on said tracks or switches
so as to interfere with, or obstruct
travel or trafile thereon.
Section 5. For the purpose of lay
ing down or repairing said railway
track, no street or roadway shall be
obstructed for greater distance than
one block at any time, nor for a longer
period than 20 days, except in cases
of unavoidable acidont or delay, or
by reason of excessively bad weather,
the City Council may extend such
time at their discretion.
Section 6. Work shall be comnienc-
ed upon all switches aud curves men
tioned in this Ordinanco, within six
monthso from acceptance thereof, and
all such switches, tracks and curves

ing down of such switches or tracks
or curves shall be forfeited with or
without any further action on the
part of the Municipal authorities of
Oregon City.
Section 7. That at all points where
said switches, tracks or curves shall
pass through any railing along said
road or" street, for the protection of
the travelling public, the said Hawley
Pulp and Paper Company shall con
struct and maintain suitable and suf
ficient gates, so that at all times when
these switches, curves and tracks are
not being actually used for the
switching, loading or unloading of
cars upon that particular part of said
track or curve, upon which said rail
way is located, said gates will be kept
closed, so as to preserve the continu-

Section 9. The failure of the Haw
ley Pulp and Paper Company to com
ply with the provisions and conditions,
or any one of them, of this Ordinance,
shall operate as a forfeiture of this
franchise and all the rights and privi
leges herein granted, and the. City
Council shall be the judges of such
failure subject to review by Courts
of competent jurisdiction, and may
declare by ordinance the forfeiture of
all rights and privileges herein .grant
ed, and may cause said tracks, curves
and switches to be removed at the ex
pense of the Hawley Pulp and Paper
Company.
Section 10. None of rthe rights,
privileges or franchises granted by,
or contained in this Ordinance shall
be sold, transferred or assigned with
out the consent of the City of Oregon
City, except upon the transfer of the
whole busmess and property of said
