vicinity of the road described in the peti
tion and praying viewers to be appointed
to view and locate a county road in
Clackamas county, Oregon, described in
full a follows:

ary crosses the Elliott Prairie and
Monitor road and running due east to
Willamette meridian; thence north on
said meridian to a point 80 rods south
of the nw corner of Sec 19, Tp 5 S, E 1
E, thence due east on a hue parallel
with the northern boundary of said sec
tion 19, to a pointin the center of the
countv road that now runs in a NW and
SE direction through said Sec 19. Said
road as prayed for to be 40 feet wide.

on the courthouse bulletin board, and
three of the most public places in vici
nity of the proposed road more than

and Bud Thompson be and are hereby
appointed viewers to meet at the be
ginning on the 2lst day of October, 1901

vised, it is ordered that John and Marga
ret Mahou be allowed the sum of $25
and the further sum of $10 per month
hereafter.
In the matter of petition of J W Root
for cancellation of double assessment:
This matter now coming on to be
heard on affidavit of J W Root filed
herein, showing to the Board that he is
the owner of lot 1, as described in Book
33, Page 470, Sec 17, Tp 2 S, R 2 E, and
has paid the taxes on the Bame for the
year 1899; that for said year said lot waB
also assessed to Jacot' jonnBon, wnicnas
ses8ment is a double assessment and now
delinauent.
And the Board being tuny advised that
said lot was doubly assessed, it is
ordered that said assessment to Jacob
Johnson for the vear 1899 be cancelled
of record.
In the matter of the funeral expenses
of F Batehelor. an indigent soldier
It is ordered that said funeral expenses
be puid in full amounting to Hi and thai
the clerk draw a warrant lor the same.
In the matter of Mrs J M Bacon, wife
of an indigent soldier:
This matter now coming on to be
heard on application of F. If. Beach and
the Board being fully advised, it is
ordered that Mrs" J M Bacon be allowed
the sum of $10 per month from October
1st, 1901.
In the matter of Mrs. E Morgan
a comity charge:
It is ordered that the cierK draw i
warrant in favor of Mrs E Morgan for
the Bum of $3 and that she be allowed

In the matter of petition of W O John
son for return of money on delinquen
tax sale
This matter now coming on to be
heard on sworn petition of W C John
son filed herein showing to the Board
that for the vear 1898, 30 acres of land in
the H Johnson D L O belonging to June
May Wade were sold for taxes and pur
chased bv 1' 11 M irlav.
That the said W O Johnson settled
with 1J II Marlav an assignment of the
certificate held by the said P II Marlay
which certificate he lias lost.
That not knowing of this settlemen
said H 11 JohiiBon redeemed said prop-
eity trom Baid Bale by paying the clerk
the sum of $10 50.
And the Board being satisfied that
Clackamas comity has no lein on said
land and that the money paid by II 11
Johnson for the same was paid through
a mistake, It is ordered that tho clerk
return to H II Johnson the amount paid
for said redemption, amounting to $10 50
In the matter of the petition of Luther
Morris for settlement of taxes:
This matter now coming on to he
heard on petition of Luther Morris filed
herein, showing to the Board that lie is
the owner of that part of the Klise D L
C belonging to what was foiinerly the
Stingos estate; that for the year 1895 b
part of said land was assessed to Tlios.

connecting with the new hiide across
the Molnlla liver.
Said surveyor tiled his report herein
tuvoiii panied by the field notes and plat
thereof ami the Board being fully ad
vised, It is ordered that said report be
accepted and upon Clackamas County's
securing titlJ to the hinds covered by
said survey, said survey and road shall
he established by Clackamas County.
It is further ordered that expense ac
count of said survey be paid as follows:

District No 3:
This matter now comint; on to be
heard on petition of A W Cooke, Super
visor District No 3, submitting his ap
pointment of Orin W Griffin as Deputy
Supervisor for said district on account of
the physical inability of the Supervisor
thereof to act, and Ihe Board being fully
advised it is ordered that said appoint
ment be hereby confirmed,

digent Soldier Funds:
This matter now coming on and it ap
oeariuir that the Continent and Indi
gent Soldier Funds are depleted, It ib
ordered that the County Treasurer trans
fer $100 from the General Fund into
each of said funds.
In the matter of petition of Mt flood
and Barlow Road Co for rebate of taxes :
This matter now coming on to be
heard on petition of E G Caufield, Treas
urer of Mt Hood and Barlow Road Co,
showing to the Board that for the year
1893, 24 miles of Toll Road near Mt
Hood belonging to said Company was
sold for taxes and bought in by Clacka
mas County, when the taxeB on said
property had been paid, and that the
then Sheriff had failed to credit the
same on the Tax Roll.
That not knowing of the payment of
said taxes and supposing that said de-
liiunieiicv was correct, the said Iv G
Caufield redeemed said property from
tax sale by paying the sum of $olj 00.
And the Board being fully satisfied
that said taxes have been paid and that
in redeeming said property said com
pany made a double payment of said
taxes, It is ordered that said company
have a rebate in the sum of $33.00.
In the matter of application of Godfrey
Shmale for aid :
Now comes Godfrey Shmale and
preBents to the Board pelition signed by
fifteen citizens of Clackamas County,
asking the Board to grant assistance to
the bearer thereof, and the Board being
fully advised, it is ordered that Godfrey
Shmale be allowed the Bum of $0 per
month from October 1st, 1901.
In the matter of petition of A E and
Royal B Holcomb for settlement of
mortgage taxes:
It is hereby ordered that the taxes as
sessed upon a certain mortgage given by
George W Holcomb and wife to the so
licitors company, recorded on page 3C4
or Book Q of mortgages, for the years
1891, 1892 and 1893, be and they are
hereby cancelled.
And be it further ordered that the tax
assessed upon a certain mortgage given
by George W Holcomb to 8 E Wren, re
corded in Book Z of Mortgages of Clack
amas County, recorded at page 02 thereof
for the year"lS90 and the certificate is
sued upon the sale of property for the
said tax assessment be and ihey are
hereby cancelled, the sum of $10 having
been paid to Clackamas County for the
cancellations aforesaid.
In the matter of Road Supervisors ;
It is ordered that Road Supervisors
who have exhausted their apportionment
of load funds, do no more work on roud
without orders from the Board.
