In the matter of a public gateway for Henry Eicliter. Now at this time comes L. Stipp, attorney for Henry Richter, and stated thht this matter had been satisfactorily settled, and he board be ing fully advised, it is ordered that said matter be dismissed from further con sideration. In the matter of the claim ofW. VV. Giesy against Clackamas county . This matttr being bill No. 26, presented at the June term of this board, for the amount of $09.25, for care of one Moses Spicer, a pauper, and the sum of $39 25 be allowed. Now comes Gordon E. Hayes, attorney for W. W. Giesy, claiming insufficient remuneration for his services in attending Moses Spicer, and the court being fully advised, it is ordered that W. VV. Giesy be ana is hereby allowed the further Bum of $23.80. Ia the matter of the petition of Isaac Pollock for rebate of pull tax for 1899. This matter now coming bv petition and the court being satisfied that Isaac Pollock paid a poll tax for the year 1899, and that he was at that time over 60 years of age. Ii is ordered that a re hate be made to the said Isaac Pollock for the sum of $3, and that the clerk is sue a warrant for same. In the matter of the Molalla and No land Mills road. This matter having been laid over irom June term on ac count of objections filed by J. D. Jor dan, the Raid J. D. Jordan, now Ap peared by his attorney, G. B. Diuoiek, and withdrew the objections filed and it appearing to the board that there is no remonstrance or petition for damages filed, and being fully satisfied that said survey be recorded and in all respects approved, and that the said view and survey be established as a county road, and the county clerk is hereby ordered to issue the necessary notice to the su pervisor of the district or districts in which said road lies, to open and work the same. In the matter of the petition of Christ ian C.Smuckor,for a road of public ease ment. Now at this time on this 3rd day cf July, 1901, this cause coming up on the Bworn petition of Christian C. Smucker, that his residence is not rtached by any convenient public road heretofore provided by law, and that it is necessary that the public shall have egress and ingress from and to his said, residence and praying for a order from the board to appoint three disinterested ficeholders to view and locate a county road 30 feet in width from his said resi dence to road No. 2G, known as the El liott Prairie road. It is ordered that Henry Wolfer, David Zimmerman and J. W. Oochrau be appointed as viewers to meet at the hour of 10 o'clock a. m., on the 29th day of July, 1901, and to view out and locate said road 30 feet in width from the residence of Christian O. Smucker, the petitioner herein, across the property of Levi Erb to said road No 26, known as the Elliott Prairie road and to assess the damages thereof. In the matter of the dam at Sucker lake belonging to the Oregon Iron& Steel Company. This matter now coming on to bj heard, and the board being fully advised, it is ordered that the clerk no tify the Oregon Iron & Steel Company, that the dam at Sucker lake, belonging to the said company, is in a dangerous condition, and that the said Company will be held responsible by Clackamas county for all damages that may occur from said dam to property in Clackamas county. In the matter of the county printing it was ordered that the board of county commissioners of Clackamas County, Oregon, will receive sealed bids up to and until August 9th, 1901, at the hour of 10 o'clock a. m., for the county print ing and the furnishing of county sup plies for the ensuing year. The print ing to consist of tax lists, execution no tices, proceedings of the board of county commissioners, legal blanks and all ad vertising and printing which the county or any of its officers is required to do, also to furnish all stationery, blank books, record books, registration blanks, election tickets and duplicates and all supplies of whatever kind and nature used by the county officers. In the matter of wood for the use of the court house, it was ordered that bids will be received by the board of county commissioners for 50 cords of well seasoned yellow fir wood four feet long cut from live timber, bids to be opened at the regular August term at 2 o'clock, August 8th, 1901. Wood to be delivered on or before October 1st, 1901. The board reserves the right to reject any and all bids. In the matter of lumber for the Ap person road, it was ordered that bids will be received by the board of county commissioners for 67,500 feet of lumber for the Abernethy road and 04,000 feet of lumber for the Appersnn road, plank to be 16 feet by 3 inches by 8 to 12 inches. Said lumber to be delivered on roads for laying down by September 20, 1901. Uids will be opened August 8th, 1901, at 2 o'clock. In the matter of the appointment of county physcitin it is ordtred that bids will be received by the board of county commissioners for a county physician for the ensuing year, said physician to furnish medicine, modioli attendance, appliances, and perform all eurgical op erations for Hie county j.til. In the matter of insurance on the court house, it is ordered that the clerk have all policies renewed whenever they expire. j In the matter of the petition of A. Cross, trustee, for the year 1SJ8, and appear- in the tax roll for 1899; said land having been doubly assessed for said year. The said land being assessed to Stella M. Ohlson, the rightful owner, and also to H. E. Cross, trustee. The tax against said land amounting to 1770, as as sessed to H. E. Cross being erroneous, and the board being fully advised, it is ordered that in omideration of the tax pssessed for said year against Stella M. Ohlson as described by metes and bounds, being paid, that the county clerk cancel the tax against TI . E. Cross, trustee, as shown on the delinquent tax roll for 1899, on the tracts above re ferred to. In the matter of the petition of John Ilendrick for rebate of poll tax for 1900. This matter now coming on for hearing to petition of J. J. Cooke and the board being satisfied that the said John ilen drick is no an able bodied man and not liable for poll tax under the laws of the state, it is ordered ' that a rebate be made to the said John Hendrick for the sum of $3, and that the clerk issue a war rant for the same. In the matter of the report of viewers in change of Keil and Buckman road In the matter of the report of R. S. Mc Laughlin, H.Thiessen and J. S. Risley appointed at the last term of this board to view and caused to be surveyed and report upon the practicability of change in the Keil and Buckman road situated in Clackamas county, Oregon, and de scribed in full on page 98 of this journal. Said viewers filed their report showing that they had met on the 1st day of July, 1901, at 10 o'clock a. m., a day named in the notice served upon them and were duly sworn by subscribing to a written oaiii of office administered by John W. Meldrum, deputy county surveyorafter which they proceeded to the designated plate and did yiew and cause to be sur veyed by said deputy county surveyor, the said described road. They also filed the field notes and plats of survey, and said viewers report favorably to the es tablishing of said road as viewed and surveyed for the reason that it is a good practical route and of public utility. Said report was read, and it appearing to the board that there is no remonstrance or petition for damages filed and being satisfied that said road will be of public utility, it is ordered and adjudged that the field notes and plat of sa-.d survey be recorded and in all respects approved and that the said view and survey be es tablished as a county road, and that the expense of said view and survey be paid byOlackames county and the clerk is hereby ordered to issue the necessary notice to the supervisor of the district or districts in which said road lies, to open and work the same. All that por tion of the road heretofore described and asked to be vacated be and the same is hereby in all respects ordered vacated on the opening of said road. This matter coming on for consideration and the board being fully advised, it ia ordered that the Oregon City & Southern Rail way Company be ordered immediately to repair the Canemah and Oregon City wagon road according to the terms of the franchise granted to the said Oregon City & Southern Railway Company; that said road is in an unsafe condition for public travel and that the said Ore gon City & Southern Railway Company is held responsible by Clackamas county for any and all accidents that have oc curred or may occur on said svagon road. In the matter of Schmale, an indigent person. This matter now coming on for hearing and the board being fully ad vised, it is ordered that the said Schmale have no more aid from Clackamas county, and that his name be and the same is hereby taken from the pauper list. In the matter of bids to build a bridge across the Molalla river, near Canby and Barlow. This matter coming on and it appearing to the board that the bid ot E. D. Olds in the sum of $9145 is the lowest bid on file in accordance with the notice as published by the county surveyor, it is therefore ordered that the contract be let to E. D. Olds as per plan and specifications are filed herein In the matter of JaneCarr, a county charge. This matter now coming on and it appearing to the board that no one is entitled to warrant No. 8127 drawn on the general fund for the month of June, for ti e care and keeping of the said Jane Cair, it is ordered that said warrant be and the same is hereby can celled aud held for naught, and that V, D. In the matter of the application of Mrs. Ida O. Gortman for aid. This matter now coming on by her personal appearance before the board, and the board being fully advised, it is ordered that the said applicant be allowed the sum of $8 per month beginning with June 1st, 1901. In the matter of the Clackamas road subscription. It appearing to the board that a considerable part of the Clacka mas road subscription is delinquent ; it is therefore ordered that said delinquent subscription be immediately collected and paid to the Commercial Bank of Oregon City. - In the matter of the petition of Phillip Streib for the vacation of Lewellen park. This matter coming on to be heard by petition of Phillip Streib, it was laid over until the August term as by law required. In the matter of the collection of taxes for 1900. Cooke, sheriff, be given an ex tension of time until August 1st, 1901. In the matter of James Wilson, a county charge, it is ordered that he be transferred to the care and keeping of W. and Ira Wilson for the sum of $12 per mi nth. In the matter of the adjustment of the adjustment of the tax of Minda E Church for 1892. This matter coming on regularly to be heard upon the pe tition of the said Minda E. Church, and it appearing to the board that the said Miuda E. Church was the owner in the year 1.492, of lots 1, 2 and 3, in blk 130 in County Additon to Oregon City, that she was assessed for said year on lots 1, 2 and 3 in bik 30,instead of 130 as above ; that the same was illegally sold under imperfect description on August 5th, 1893 along with other property belong ing to said petitioner.
