In the matter of the resurvey of the
Noland mill road.
In the matter of the report of W P
Herman, Cbas. Daugherty and F E Al
bright, viewers, appointed at the last
term of this board to view and relocate a
county road known as the Molalla and
Poland's mill road, situated in Clacka
mas county, State of Oregon, said view
ers filed their report showing that they
had met on the 24th day of May 1901, a
day named in the notice served upon
them, and were duly sworn by subscrib
ing to a written oath of office adminis
tered by John A Meldium, deputy county
surveyor after which they proceeded to
the designated place, and did view and
caused to be resurveyed by said deputy
county surveyor the above named road.
They also filed the field notes and plat of
the survey ; said viewers report favorably
to the establishing of said road as
viewed and resurveyed for the reasons
that it Is a good practical route and of
public utility; Baid report was read on
this day upon its first reading, and it ap
pearing to the board that J D Jordan,
one of the property owners through
whose lands said road runs has filed ob
jections herein, and the said Jordan by
his attorney, G B Dimick, asking for
more time in the matter, it is ordered
that said matter be and hereby is laid
over until Friday, the 5th day of July,
1901.
In the matter of delinquent taxes on
E. E. Magone 15 acre tract D. D.
Tompkins D. L. C, it appears to the
court that there are delinquent taxes on
the years 1888-1889-1893-1805-1808 on
Hollowing described land to-wit: Part
D. D. Tompkins D. L. C. No. 65 begin
ning at i. K. corner of William Huuhes'
land in D. D, Tompkins D. L. C. in T. 2
8., R. 1 and 2 E. of W . M. thence S. 4.22
chains, thence h. 37 97 chains to lllam
ette river, thence N. with meanders of
river 2.1 chains, thence N. 27 degrees W,
1.80 chains, thence W. 37.15 chains to
filace of beginning and 15 acres more or
est), and that there are errors in the de
scription of said land in assessment and
sale of the same. It is orderea that on
payment of $40 00 to the countv clerk of
this court, he cancel all ot delinquent
taxes on said land to this date.
In the matter of the assessment of the
property belonging to State Land Board.
Now at this tune conies on to be heard
the petition of Antone Schaffers asking
for the cancellation of the taxes assessed

property belonged to the State Land
Hoard at the time said assessment was
made ami that the said property is not

Jenny E. Curry for taxes on lots in
Marchbanks so far as the same is shown
on tbe list made up by the clerk for
sales on toe 1st Monday in July, 1UU1
before payment by Baid Riley, of the
amount shown in said list.
In the matter of the establishment of
a public gateway for Mrs. E, Wehrheim,
as provided by order of board of county
commisioners made and entered on the
4th day of May, 1901 and appointing Ed
Bates, Geo. Ely and James Kitching
viewers to view locate and assess dam
ages for said gateway, and it appearing
to the said board, tbat the said viewers
met at the time and place appointed and
alter subscribing to an oath to perform
their duties according to law to the best
of their abilities, and after having com
pleted tbelr view and location and
having assessed the damages therefor,
and it further appearing to the said
Board that the damages assessed by said
viewers are just and that the said gate
way was so located as to do the least
damages to tbe lands crossed and that
the report of the viewers is just, and
that the costs of locating said gateway
have been paid and that the damages
bave been paid into court for said per
sons whose property was crossed, It is
ordered that said report be and tbe same
hereby is confirmed and sa.d gateway is
hereby declared to be a pnblic gateway
and perpetual right of way and to be re
corded as such.
