FIREMEN NOMINATIONS.
Several Candidates for Depart
ment Officers Nominated.
. Under the provisions of the new ordi
nance regulating the fire department,
the board of fire delegates no longer ex
ists, and the department is now under
control of the board of fire commission
era, consisting of the city council com
mittee of fire and water, and three mem
bers elected by the fire department.
The mayor is also a member and pief i
dent of the board. The firemen's elec
tion will be held on the first Monday in
March, and the principal contest will
probably be on account of the candi
dates for chief engineer. Only three
candidates for commissioners have been
named, but neither the Uataracts or
Number Four at Ely have yet made
nominations. :
, The members of Hose Company No.
4, met in their hall at Ely Saturday
night, and decided not to make any
nominations for chief engineer, assist
ant engineer, or any of the three mem
bers of the board of fire commissioners,
but voluntarily agreed to support can
didates named by some of the other
companies.
Hose Company No. 3 held a meeting
Monday night and nominated C. M.
Mason for chief engineer, and A. Rob
ertson for commissioner.
. The Hook and Ladder Company held a
meeting Wednesday night and nomi
nated Charles Moore for chief engineer,
and J. W. Cole for commissioner. Thpy
also elected the following officers for
the ensuing year: President, Allen
Berry; vice-president, Charles Pope;
secretary, J. E.Khoades; treasurer, J.
W Cole; foreman, Sherman Burford;
assistant foreman, Ed Brown, janitor,
Joe Austin.
Fountain HoseOompany No. 1 held a
meeting on the same evening, and nom
inated F. T. Rogers for assistant engin
eer, and Eli Maddock for fire commis
sioner. The following officers were
elected for the ensuing year: Presi
dent, A. Knapp; secretary, Paul Hem
melgarn j treasurer, 8. R. Green ; fore
man, Adolph Willey j 1st assistant fore
man, H. W. Jackson ; second assistant
foreman, George Warner.
The Hook and Ladder and Fountain
Hose Companies endorsed the nomina
tions made bv each other.
Cataract Hose Company will hold a
meeting tonight to make nominations,
and will probably elect otlicers.
Hose ComDanv No. 3 will elect ofB
cers on the third Tuesday evening in
this month.
Frobate Court.
On petition of J. C. Hungerford, of
MUwaukio, an order was made Mat
W. T. Bunnell, administrator of the
estate of Chnrles Bunnell, deceased,
hie a new undertaking, as some of the
bondsmen on the former undertaking
are now dead.
Sarah M. McCown, executor of the
Inst will and testament of K 0. toe
Cown, deceased, filed her final account,
and all conveyances of real estate men
tioned in said report were approved and
C ntirmed.
The lust will and testament of James
G, Wilson, deceased, who died at Mil-
wnnkio, January 7th, was admitted to
probate Monday. The estate consists of
fCiOO in lite insurance policies, and
$1500 of this amount is bequeathed
equally among the six children, and
the remainder of the property is de
vised to the widow, Margaret A, Wil
son. The will, also nrovi.les that Mrs
Wilson shall be guardian of the minor
children and executor ol the will with
out bonds or security.
In the matter of the estate of Josiah
Franklin, deceased, S. R. Taylor, ad
ministrator, filed his final report, and
was ordered to pay over $1)01 05 to the
widow, Mrs. A. E. Franklin, and the
remaining one-fourth to Hannah A.
Nicklin, Sarah E. Hollenbeck, W. II.
Franklin and Charles E Moody, and
that the real estate be distributed ac
cording to law. i
K. G. Onu field was appointed admin
istrator of the estate ol Luke Comer,
deceased.
' T. A, Baker tendered his resignation
as administrator of the estate of Au
gusta Melchcr, deceased, which was ac
cepted, and Max Sohulpius was ap
pointed as his successor.
The executrix of tho eetato of Iavid
Keller, deceustd, was granted further
time in which to tile an inventory on
account of illness.
In tho matter of the estate of James
Forsylhe, deceased, Aurora C. Forsylhe,

Under the management of General
Secretary J . L. Mead a very croditablo
benefit entertainment was given at
Shively's hull last Saturday night. As
the proceeds were for the solo benefit of
the building fund of the local Y. M. O.
A., the luck of attendance was proba
bly duo to the extreme cold weather,
hb people had a horror of getting out in
the bitter, frosty night air.
The entertainment was given entirely
by Portland star talent, who responded
to the many enthusiastic encores. There
were selections by the male quartette ;
Mark E. Bronson gave a recitation, and
Will Spencer gave a splendid exhibi
tion of fancy club swinging Judge
Frank Hennessy added golden laurels
to reputation as a soloist, while Prof,
Yoder gave some excellent selections on
the piano. Joe Hayes gave some clever
character sketches, but he had evi
dently attended Oordray'g, and heard
Martell's, and didn't know that they
had been here the week previous, o.' he
would not have repeated so many of
their numbers, Lawrence Wilhelm'g
impersonations wermery good Billie
may be noted as a trick bicyclist in
Portland, but he don't o ome up to the
standaid in Oregon City, He couldn't
hold a wax mutch to Murtell, and there
are kid on upper Seventh street, that
can almost equal him in good weather.
However, taken as a w hole, it whs a
most excellent entertaiment. and de
served a crowded house on its merits
alone.

CONTEMPT OF COURT.
The Dignity of Justice Schuebel's
Court was Sustained, and An
other Cliapter was Added
to Oregon History.
There was a red-hot, interesting time
in the annals of Justice Schuebel's
court for a period of days including the
latter part of last week, and the best
half of the present seven-day period.
Roy Pollock, an employe of the Daner
mills, swore out a complaint, charging
Fred Rounds, a fellow workman with
assault. When the case came ud to be
heard Saturday, neither the prosecuting
or other witnesses were in evidence, al
though a jury had been empanelled to
try the case.
This state of affairs made Justice
Schuebel a little warm in the collar,
and he straightway ordered bench war
rants for the arrest of Jack Kugleman,
for intimidating and bribing Witnesses,
and Roy Pollock, both for contempt of
court. Kugleman pleaded guilty on
Monday morning and was fined $5,
while Pollock was sentenced to confine
ment in the county jail until Tuesday
evening, when the case was called up
again. On account of the fact that
Pollock had been bribed, or was intim
idated, at that he did not appear when
the case was called, the jury taxed
Rounds $25 for making the assault.
Justice Schuebel, however, remitted a
portion of the fine. Pollock ia only a
boy, and undue influences were evi
dently used to prevent him from ap
pearing at the trial.

Referendum Amendment.
The initiative and referendum resolu
tion was introduced by Representative
Kruse at request of W. S. U'Ren and
passed both houses. It will have to be
passed by another legislature before be
ing voted upon by the people :
Resolved by the bouse, the senate
concurri. g, That the following amend
ment to the constitution of the state ol
Oregon be and the same is hereby pro
posed :
Section 1 of Article IV of the constitu
tion shall be and hereby is amended to
read as follows :
Sec. 1. The legislative authority of
the state shall be vested in a legislative
assembly, consisting of a senate and
house of representatives, but the people
reterve lo themselves power to propose
laws and amendments to the constitu
tion and to enact or reject the same at
the polls, independent of the legislative)
assembly, and also reserve power at
their own option to approve or reject at
the polls any act of the legislative as
sembly. The first power reserved by
the people is the initiative, and not more
than eight per cent of the legal voters
shall be required to propose any meas
ure by such petition, and every such
petition shall include the full text of the
measure so proposed. Initiative peti
tions shall be filed with the secretary of
state not less than tour months before
the election at which they are to be
voted upon, The second power is the
referendum, and it may be ordered (ex
cept as to laws necessary for the imme
diate preservation of the public peace,
health or safety), either by petition
signed by five per cent of the" legal vot
eis, or by the legislative assembly as
otl.er bills are enacted. Referendum
petitions shall be filed with the secreta
ry of state not mora than ninety days
after the final adjournment of the ses
sion of the legislative assembly which
passed the bill on which the referendum
is demanded. The veto power of the
governor shall not extend to measures
referred to the people. All elections on
measures referred to the people of the
slate shall be had at the biennial regular
general eletious, except when the legis
lative assembly shall order a special
election. Any measure referred to the
people shall take etlect and become the
law when it is approved by a niaiority
of the votes cast thereon and not other
wise. The style of all bills shall be ''Be
it enacted by the people of the state of
Oregon." This section shall not be
construed to deprive any member of the
legislative assembly of the right to in
troduce Bny measure. Tho whole num
ber of votes cast for justice of the su
preme court at the regular election last
preceding the filing of any petition for
the initiative or for the referendum shall
be the basis on which the number ot
legal voters necessary to sign such peti
tion shall be counted. Petitions and
orders for the initiative ami for the ref
erendum shall be filed w ith the secreta
ry of state, and in submitting the sumo
to the people he and all other officers

Batv, Diana Baty and Charlos Dougherty, heirs
and devisecs of Robert Baty, Deceased, defend,
ants, for the sum ol $096.00, with Interest thereon at
the rate of 10 per cent.per annum from the 22d day
of November, 1898, and the further sum of S10.00
co-ts and disbursements, and the costs of and
upon this writ, commanding me to make sale of
Hie following described real property, situate ill
the County of Clacknnias, State of Oregun, to-wlt:
All of section 16, township 5 south, range 8 east
of Willamette meridian, containing 840 acres.
