The work has been accepted by n ma jority of the coiincilmen, yet it is unsatisfactory to nearly till of the property owners interested. Many of them have emphatically declared that they will resist payment. Just what the mode of procedure will be is yet indefinite. They do not ob ject to the price, but they do object to paying a contractor for doing something that he did not do. The sewer may be good in spots but it was not what wns bargained for. They have a right to kick, and it is right that they should do their kicking at this time. The four councilmcn who voted for acceptance evidently deemed the sewer good in spite of the act that the specifications were not touowcu. 1 lie otner turcc am not. That things will be stirring In regard to it is very evident. The annexation case was tried in Judge Gatcu's court this week. The argument is all in and a dc clstou of the judge is anxiously awaited by the populace here. Geo. J. Perkins has charge for the nulls, while Senator Fulton is looking after the annexationists' interests The argument of Mr. Perkins showed deep research and know ledge of the law that was almost amazing. Ills chief contention is that the vote was taken under pro visions of on obsolete and nullified law. Whether this city becomes it part of Portland is still an open question. We understand, liowev cr, that If the otitis lose the decis ion it will be taken to the .supreme court. Prof. C.C.
