Sunday Closing Must Be Observed in Oregon In the decision, as announced last week, given by Judge Bradahaw in Chambers at The Dalles in the case of State of Oregon against Dennis Carmody, a pool hall owner of Bend, the judge has held the so called Sunday closing statute valid. In other jurisdictions the law has been variously held to be valid and invalid. The decision comes as the climax to the movement started last spring by District Attorney Wirtz l ami v cu;ee p 1, in.:.. i. .1 the pool-rooms and bowling alleys throughout the county on Sunday, which met with resistance at Bend and threats to begin damage actions against the sheriff and his bonds men. The law held to be valid by Judge Bradshaw, however, applies to places of business other than simply pool halls and bowling alleys, the exact wording being as follows: Section 2125. If any person shall keep open any store, shop, grocery, bowling alley, billiard room, or tippling house, for the Durpose of labor or traffic, or any place of amusement, on the first day of the week, commonly called ! j Sunday," or the Lord's Day," such person, upon conviction there of, shall be punished by a fine not less than $5 nor more than f 50; : provided, however, that the above provisions shall not apply to the !atres, the keepers of drug stores, doctors shops, undertakers, livery , stable keepers, butchers and bakers; ; and all circumstances of necessity and mercy may be pleaded in de. iense, wnicn snail De treated as i questions of fact for the jury to j determine when the offense is tried 1 by jury." A case involving the question de. cided by Judge Bradshaw is now pending in the supreme court, hav ing been appealed from Lane coun ty and will be determined bv the highest court some time this spring. The Carmody case was taken be fore the circuit court upon a stipu lation of facts in order to get a ruling on the law, Carmody being represented by Attorneys Vernon A. Forbes and II. II. DeArmond of Bend and the state by District Attorney Wirtz. The case was ap pealed from Justice of the Peace Bowman's court when the last case against Carmody was brought. Judge Bradshaw found Carmody guilty and fined him $20.
