The so-called Medford rate bill, which was adopted by the ' people under the initiative on Novem . ber 5, 1912, and which made sweeping : changes in freight rates in the state, '' has been declared unconstitutional and void in a decision by Judges Wol- verton and Bean, of tbe United States district court in Portland, and Judge Gilbert, of the United State court of : appeals in San Francisco, before whom, sitting en banc, it was argued a little more than seven months ago. The decision was announced in an j opinibn written and delivered from the bench by Judge Wolverton. All ! three Judges fully concurred in every atpect of the decision. The measure haB been generally re ferred to as the "Medford" rate bill because of charges that It was pre pared and placed on the ballot in the selfish interests of Medford mer chants. Appealed to by railroad men and shippers for relief against what it was ; declared would be a disaster to the 1 state if permitted to go into effect, the federal court granted a temporary injunction against the operation of I the act shortly after its passage.
