Whereupon court adjourned subject

Court was called in special session
Judge Springer this 15th day of March,
1913.
It appearing to the court that con
siderable expense in auto hire may be
saved the, county should it own its own
automobile, it is hereby ordered that
the county purchase a Haynes 40, the
price to be paid being $2400, the follow
ing extras to be thrown in one casing,
three tubes, one set of weed chains.
One power pump for inflating tires and
that the clerk is hereby instructed to
draw a warrant in favor of Joseph
Pacquet of Portland for the above sum.
It is also ordered that the sheriff be
authorized to keep same duly insured
with the company its agents had same
insured with.
Report oi txpertJ. M. Wilson was
submitted to the court and ordered pub
lished with the other proceedings. The
court and clerk are instructed to draw
warrant in favor of the said J. H. Wil
son for the sum of J230.
In the matter of the petition of
(Ashwood) et al for a county road,
road ordered opened when funds are
available.
In the matter of the completion of
the Boegli grade, it is ordered that the.
clerk advertise for bids for its complt-
tion according to specifications.
Petition being presented that roads of
district No, 2 have been obstructed by
the telephone company, supervisor for
that district is hereby ordered to clear
same.
Whereupon, court adjourned subject
to call this 15th day of March, 1913.

Dear Sir:
I am today in receipt of your letter
of the 10th inBtant in which you ask
for an opinion concerning the disposi
tion of various fee and mileages earn
ed by the sheriff of your county. You
wish to know whether or not he should
turn the same over to the county treas
urer, or could he keep them in addition
to his regular salary.
Replying I would state that it is pro
vided in Chapter 199 of the General
Law of Oregon for 1911, that:
"1 he said omcer shall receive no
other compensation whatever for their
services, and all fees collected under ex
isting laws, by them, shall be turned
into the county treasury of said county. "
I am of the opinion that this restric
tion applies to all of the county officers.
and that all fees collected by any of
the county officers should be turned in
to the county treasury.

no longer authorised to be collected by
sheriffs, the same having been super
ceeded by the flat-salary law for coun
ty officer.
The attorney general discusses this
question at length comparing th sev
eral salary bill and flat-salary bills,
and declares that all such fee cannot
be collected.
He is further furtifted in this opinion
by a ruling of the supreme court in the
case of the State ex rl V, Dunbar, 53
Or. 45, declaring that when a law was
passed placing an officer on flat salary,
whose compensation wa previously
gained from fees, and there is no law
providing that such fee shall continue
to be collected for the benefit of the
county, that they cannot be collected,
as there is no authority therefor.
Having a doubt in this matter 1 ad
dressed a letter to the attorney general
asking him how these fee should be
disposed of, and his letter I attach
