In the matter of the petition of R. J. Early et al for a county road; the matter was continued because of defective petition. In the matter of the ietition of S D Mustard ct al, for a county road; the matter was continued up on the request of the Hoard of Road Viewer to whom the same had been referred for further consideration. In the matter of the petition of Dan Catlow et al for a county road, because of defective notice the same it continued. In tho matter of the petition of J A Vosburg et al for a county roal, continued for failure to die allldavlt of posting notices. In the matter of the petition of G W Wells et al for a county road. Board of Road Viewer to view out aid road on Feb 20, 1913.' In the matter of the petition of J II Davis et al for a county road, Hoard of Road Viewer to view out said road on Feb 18, 1913. In the matter of the petition of Frank F Finch ct al for a county road, Board of Road Viewers to view out said road on Feb 19, 1913. In tho matter of the petition of J W Peterson et al for a county road, Hoard of Road Viewers to view out aid noad on Feb 22, 1U13. In the matter of the petition of C Pedersen etal for a county road, board of road viewers to view out said road on Feb 25, 1913. In the matter of the wrongful assessment of J. R. Knox et al, it is ordered that the clerk credit the sheriff for the yesr 1911 with the amounts as follows: J R Knox . ...f30 00 John Burnett 2 02 Bates & Young 3 20 In the mutter of the double as sessment of the D E Hunter Realty Co. on lot 1, block 6, Bend, rebate of 15.27 (the amount of overpay ment) allowed. Warrant No. 533 for 121.05 in favor of the Northwest School Fix ture Co. was ordered canceled, the account for which the same had been drawn, having been paid. In the matter of the expenses of the county institute, it ordered that the report of R. A. Ford be approv ed. The request of H. A. Foster, as sessor, for $25 for stamps, station ery, etc., for his office, was granted. The request of Frank Elkins, sheriff, for 1 100 for stamps, station ery, etc., for hia office vas granted. The petition of C. M. Redfield et al for a voting precinct at Des c'.iutes was continued until the May term. It appearing that Redmond pre cinct was without a justice of the peace, the one elected at the last election having failed to qualify, W. C. Walker is appointed justice of the peace for Redmond precinct to serve until the next general elec tion. In tho matter of the petition for an election under the local option law at Metolius, Oregon, ordered that an election as prayed for in said petition be held February 18, 1913. In tho matter of the bill of R M Elder for building bridges over the Central Oregon Irrigation Co' ean al, ordered that the county clerk notify said Irrigation company of said amounts and request the pay ment of the same. Bond of II A Foster for assessor for 15,000 with the United State Fidelity and Guarantee Co. approv ed and ordered filed. Bond of Fred A Rice a urveyor for 15,000, with T M Baldwin and F B Foster as surety, approved and ordered filed. Bond of P B Polndexter as coro ner in the sum of $3,000, with W F King and W A Booth as sureties, ap proved and ordered filed. Viewers report road second time in open court and the following roads were declared public highways: Hugh Lister etal; C D Preston et al; V Sehreder et al; Henry Bivcns et al; Albert Moore et al; J. S Mc Vey etal; C W Hunter et al. Bond of Warren Brown as county clerk in the sum, of 110,000, with W A Booth and G W Noble as sure ties, approved and ordered filed. In the following roads the papers were ordered sent to the district at torney for hi opinion a to their validity : D G Byram et al; S E West et al; W M Ogg et al; R A Merchant et al. Report of county clerk presented showing payment of bounty on 529 coyote scalps and 86 bob-cat front feet, amounting in all to I9G5.50. In the matter of E A Knott et al petition for county road, board of road viewers to view out said pro prosed road on February 20, 1913. In the matter os the claim of Ben ton county against Crook county, continued, to allow for investiga tion of same. In the matter of the amount of the bond of the county treasurer was ordered that a bond of $20,000 would lm ample security until the further order of the court. In the matter of the petition of Ella D Peterson et al for a county road, viewers report read second time and approved and said road viewers recommending part of said road only it was necessary that the prayers of the petitioners be dis allowed. In the matter of the accounting of the emergency road, report of II C Ellis from Jan. 1, 1912 to Jan. 1, 1913, approved and ordered filed. Report of M G Hawthorn, road supervisor, for the months of Octo ber and November, in regard to the II B Ford road, accompanied by re port of H L Meuret, expert account ant, verifying the reports and ex penditures of said Hawthorn, ap proved. Report of M J Danielson in re gard to cement and structure line work done in the county bridge in district No. 12, accompanied by the report of H L Meuret, expert accountant, 'verifying the reports and expenditures of the said Daniel son, presented, and report showing a balance of$15.8G; ordered that up on the payment to the county clerk of Crook county road fund of said $15.86 by said Danielson, that said reports be approved. In the matter of the report of L Metke in regard to sundry road work di ri ig 1912, said matter was continued becausle said report was not sufficiently explicit. Report from April 1st, 1912, to dule of Ralph L Jordun, treasurer of the special road fund, presented, and approved as apparently cor rect. Plat for the extension of East E street, Prineville, presented and ap proved. In the matter of the official coun ty newspaper for 1913, it appearing that the Crook Cnunty Journal has the largest bona fide circulation within Crook county, ordered that said Crook County Journal be and the same is hereby designated as the official county paper of Crook county, Oregon, for the year 1913. Further ordered said paper be paid the um of $240 per annum, pay able in installment of $40 at each regular term of thi court for the publication of all proceedings of the county court, claims, advertise ments, notices, report of officers and agent of Crook county and any other county printing, except the delinquent tax list ; and for the publication of the delinquent tax list to receive thirty cents per square of ten line if brevier type, (news paper measure), provided that in no case shall the entire cost of the publication of such delinquent tax list exceed $500. All proceeding, including the claims presented to be published in one regular issue, and the entire delinquent tax list also to be published in one issue. Fur ther ordered that in case the Bend Bulletin and the Madras Pioneer, or either of them, consent and agree to publish the identical proceedings that are required to be published in and by said Crook County Journ al, except the delinquent tax list., that this court pay to each or either of said papers last mentioned, making such publication, a sum equal to one half of that hereby al lowed the county official paper, pay able in installments of $20 at each term of thi court; also ordered that all printing above mentioned by the official county paper or in the Bend Bulletin and the Madras Pioneer, or either of them, shall be from copy furnished said papers by Crook county, and that the cost thereof shall be ' paid at the July, 1913, and the January, 1914, terms of this court, by the paper or pa pers receiving said service. In the matter of the petition for the vacation of certain portions of the Pauline Creek and Powell Butte road ; Sisemore road ; Ovid W. B. Riley et al road ; the same was con tinued to" allow time for the filing of the following evidence : 1st. Evidence filed with this court of the legal extension and dedication of Wall street in Bend, to connect with the so-called Bend Laidlaw road, and a dedicated street in the townsite of Lytle. 2d. The legal dedication to the public and approval by the proper officials of the municipality of Bend of a street or highway leading west erly frotn said entension of W7all street toward the present county bridge, not less than 60 feet wide at its easterly end, to the center of the Deschutes river, and 100 feet wide for a distance approximately 200 feet- immediately east of the center of said river, a map of which said strip of land showing the de tails of said proposed road, com monly known as Ellis Ave., has been submitted to this court, in formally) heretofore. The widening of this street at the westerly end thereof to 100 feet, being 50 feet on either side of the center line of said bridge and road approaching the same, is for the purpose of providing means of con venient access for all time by the public in general to and into the waters of the Deschutes river. 3d. A deed of an easement or right away to the public of a strip of land not less than 60 feet wide extending westerly from the center of the Deschutes river where the name is crossed by the present coun ty bridge to connect with a street or avenue in the townsite of Ken wood ; said right of way or ease ment to be in full force and effect until the filinsf ;nd approval by this court of a plai containing a street or avenue connoting with the point of beginning f the easement above mentioned, to-wit: the center of the center of the Deschutes river, where the same is crossed by the present county bridge, and joining by a reasonable direct system or lystems, of streets with the present dedica ted streets of the townsite of Ken wood. Further ordered in said matter that copies of the action of thi court be mailed to the follow ing partie : The D E Hunter Realty Co,. Bend, Ore.; The Bend Co.,Bend, Ore.; City of Bend, care of G P Putnam, mayor; V A Forbes, attor ney for petitioners, Bend, Ore. Court adjourned until Monday, January 6, 1913. Pursuant to adjournment court reconvened at 10 o'clock a. m. on Monday, January 6, 1913, when were present: G. Springer, judge, presiding; R. H. Bailey, commissioner, Willi W. Brown, commissioner, Frank Elkins, sheriff, and Warren Brown, county clerk. Whereupon the following pro ceedings were had, to-wit: Road supervisors for 1913. Re ceived list of road supervisors ap pointed by Judge Ellis and the list is ordered filed. Report of C. R. Henry as road supervisor in Dist No. 20, approved and bill for $150 allowed. In the matter of the appointment of a truant officer for 1913 Upon the recommendation of Supt Myers Victor Shaw was appointed truant officer for three months at a salary of $20 a month. Bond of Ralph Jordan as treas urer for $30,000, offered temporary until books may be experted, ac cepted. Bond of Frank Elkins as sheriff for $10,000 and as tax collector for $20,000, approved. In the matter of petition for county road by M C Awbrey et al, all proceedings bing found regular, ordered that the surveyor and view ers meet on Feb 24, 1913, and pro ceed to lay out and establish said road. In the matter of obstruction of county road. Lockard Stage Co. reports that the Cove Power Co. are hindering traffic and transpor tation by setting poles in a traveled road, the clerk is instructed to no tify said company to provide a good and suitable road past such obstruc tions. In regard to the authority of surety companies to do business in this state, ordered that the clerk write the state insurance commis sioner for a certified list showing that the United States Fidelity and Guaranty Co. is authorized to do business in this state. " In the matter of wood for 1913. The clerk is ordered to call for bids for 100 cords of pine for the court house and 80 cords, juniper pre ferred, for the high school. Bids to be opened on the first Wednes day in March next In the matter of the board of road viewers, for 1913. Ordered that Henry Grimes and Geo Wells be and they are hereby reappointed. In the matUr of timber eruising. i he county clerk is instructed to correspond with all individuals and companies owning timber in the county with the view of obtaining a correct estimate of the timber for assessment purposes.
