Governor West also declared
thut the sulo of options must
cease. Stato Treasurer Kay
said ho would back the Governor
up In this move, only ho desired
to explain his attitude.
"Tho Governor believes there
has been a vlolulioii of tho con
tract," said tho State Treasurer,
"and has so expressed himself
frequently. As funis I am con
cerned I do not agree with him
as to a violation of tho contruct.
It seems to bo the consonsus of
opinion anions; attorneys with
whom I have discussed tho mat
ter that tho contract is not beinr
violated In sellinjr options and
that wo have no legal recourse.
Yet, if thoro is a cause of action
I believe it should bo taken up
through tho courts."
Attorney General Crawford
was tho only member of tho
Hoard voting "no," Secretary
Olcott voting with the tiovernor,
but not explaining his vote.

satisfied that there had been n i
violation of tho contract; tha'. in
his absence Attornoy Bristol, of
Portland, had advised the Hoard
that thero had boon no viola! i m
und that he, as Attorney-General
agreed with Bristol thoroughly;
thut there hud been no evidence
of sales of land or evidence th, t
settlers had ever boon on the
lund or v ere on tho land now and
that he was further of the opinion
that the company was acting
well within its rights end that it
would not only bo useless but
would be a detriment to the state
to take the step proposed.
"I believe the Desert Land
Board would be placing itself in
a position where it would be re
tarding the growth of tho state
and interfering with its prospar
ity," he said.
Governor West in making his
statement declared thut . bo be
lieved tho contract forbids tho
sales of such options; thut if it
does not it is nevertheless wrong
aud places tho settlors in an un
certain and unsafo position and
that it should be stopped or tho
contract forfeited.
