to visit, frequent, or remain In or
about his place of business longer

cause them to be ejected, and It shull

sons in hU or their employ to vend,
sell, barter, exchange, or otherwise
dispose of any lutoxlcatlng liquors,
falling within the classes enumerated

any woman or women, minor or

ards, or persons In the sta.e of in

guilty of a misdemeanor, and upon
conviction thereof in the Recorder's
Court, ol the city of Prineville, shall
be fined not less than Twenty-five
dollars, nor more than One Hundred
Dollars, together with the costs ol
prosecution, aud In default of such
fine and costs, shull be confined lu
the city jail one day for every two
dollars of such fiue and costs, not to
exceed thirty days.
Six. 8. It shall lie unlawful for
any person, or persons, to whom a
liceuse has lieeu granted, under tin
terms and conditions of this ord -nance,
or permit any perton, or per
sons, In his or their employ, to keep
bis place of business open on the first
day of the week, coinmoulv called
Sunday, between the hours if 12
o'clock midnight Saturday, and 5
o'clock a m. Monday, or to
allow auy person, or persons,
to inter his eald plfcce of
business ou said day, or dispose of.
or cause to be sold or disposed of,
any intoxicating liquors, of any ol
the classes enumerated la section
one of this ordinance, on said day.
And it shall be unlawful for such
person, or persons, or permit
any j ergon, or persons, in
his or their employ, to
keep open said pluce of business be
tween the hours of 12 o'clock, mid
night and 5 o'clock the
following morning, or to
keep open his place business on
election day, whether the same be
un election held for City, Couuty or
State, while voting Is in progress,
and any person, or persons, violat
ing the provisions ,f this section,
shall be deemed guilty of a misde
meanor, and upon conviction there
of, In the Recorder's Court, shall be
fined not less thun twenty-five dol
lurs, nor more than one hundred
dollars, and pay the costs of prose
cution, and lu default thereof, in the
payment of such lines aud costs,
shall be Imprisoned in the city jail
not less than twelve duys, nor more
than thirty days.

any jerson or persons, to
whom a license has been issued,
under the provisions of this
ordinance, to fail, neglect, or
refuse to pn vide, and maintain, un
open front to his or their place of
business, lu the manner and form, as
provided In section two of this ordi
nance, shall be deemed guilty of a
misdemeanor, and upon conviction
thereof, In the Recorder's Court, of
the City of Prineville, shall be fined
not less than twenty five dollars,
nor more thuu one hundred dollars,
together with the cost of prose
cution, and upon defivilt 1 1 tl e pay

nor more than thirty days, or both

would have applied on the remainder
of the term for which said license
was Issued, and the findings of the
Recorder's court of such three seiie
rate and distinct violations aud con-
victlons thereunder shall Ik- con
clusive, and no aptieul shall be taken
therefrom, and the said person or
persous to whom a liceuse has been
issued and whose license lias been
thus terminated, revoked or an-

apply for auother license, and the
said bond or undertaking shall also
be f orfel ted. and the sum of money
named thereiu may lie recovered
from the principal or the surety or
auretl -s, oreither of them, or both,
as liquidated damacei, recoverable

lation of said bond or undertaking,
and no evidence shall be requ'r d 1::
such action or suit. Instituted bv the
city of Prineville, for the forfeiture of
such bond or undertaking, except to
prove tne execution of the same, the
.'ranting of the license thereunder.

Skc. 12. If the license granted to
any person or persons under the
terms 01 this ordinance, shall be re
voked, annulled or set aside, as pro
vlded for by section eleven of this
ordinance, and If the bond or 1 n ler-
taklng as provided for in section two
of this ordinance shull lie forfeited,
for the violation or violations of the
condition or condlilons appearing
luerein, ana me person or persons
holding said license, mid who exe.
cuted said bond, if he or they shall
thereafter, vend, sell, barter or ex
change, or otherwise dispose of in
toxicating liquors ol the classes de.

out first having procured a license

Inoperative for a period of several
mouths anil such delay will be a
menace to the public welfare, good
order und peace of the eltv of Prlne
ville, and tha InhabltaLts thereof,
therefore an emergency is hereby de
clared, and the taking eflect of this
o-diuauce Is immediately necessary
f r the preservation of the peace,
welfare aud safety of the City of
Prineville, and this ordinunce shall
tuku effect In all the terms and pro
visions thereof, from aud after its
approvul by the Mayor.
