Another determined effort U to be
made in the court to have m receiver
appointed for the Deschute Irrigation
& Power Company. The Id case, in

which John G. Peehler, the principal
Ohio claimant before, has been elimi
nated from the papers. The latest suit
is in the name of Frank R. Shinn and
L. G. Addison, who appear on the
pleading as a "committee for certain
bondholders." In the accompanying
affidavit it is explained that Deshler
has been compelled by ill health to
withdraw from bis connections with the
case. It will be remembered when the
other case, brought in the nsme of
Deshler, was up for argument, the at
torneya for the Deschutes Irrigation A
Power Company produced a telegram in
court from Deshler, stating that he did
not care to pres a the cafe.
In an extremely long complaint and
series of exhibits, the Ohio bondholders
et forth that they are the lawful pos
sessors of $313,000 of the first mortgage
bonds issued by the company when un
dertaking the irrigation enterprise, and
that the interest dates passed br the
company without meeting their obliga
tions were September, 1908, March,
1909, and September, 1909. It is alleged
that the terms of the bonds make prin-
cipal due whenever default in interest
; occurs, and that the bondholders sued
for interest and principal, while such
default existed. After suit began, it is
, stated, on December SI, 1909, the irriga
tion company management tendered
the defaulted interest, aggregating $33,
925, but this payment was refused by
the bondholders, as they say they
; wanted the principal also paid at the
same time.
The action is now taking somewhat
y new form. At the time of the prior
I bearing, interest had been unpaid, and
one of the strongest arguments made in
behalf of the Ohio bondholders for a re
ceiver was that interest had been passed
and the company should be considered
bankrupt. TSow the tender of the in
terest has been made, but is declined
on the ground that both principal and
interest are made due and payable by
.the default of the three successive dates,

shall not be appointed, else the petition
of the creditors will be granted.
No new allegations of a material na
ture appear in the present suit that
supplants the prior one. It is set forth
that ?359,C00 of the 1500,000 authorized
issue of bonds bad actually been issued,
that $52,000 of the authorized iue had
been hypothecated in borrowing money,
and that bonds of the par value of 88,
000 bad been paid and canceled. The
land affected is the original Pilot Butte
Development Company segregation of
84,707 acres, the original Oregon Irriga
tion Company segregation of 56,006
acres, and the January, 1909, segrega
tion of 74,198 acres, given to the present
company. Of the total, it is alleged
that 49,000 acres have been told. The
Merchants Saving & Trust Company is
said to hold $157,371 of the bonds of the
company, and also $61,344 of settlers'
notes which have been deposited as a
sinking fund. In the sinking fund it is
alleged that there is now only $88,000
of cancelled bonds of the company, and
settlers' promissory notes aggregating
$72,707 when if the terms of the bonds
were complied with there should be on
hand $187,852, on a certain contingency
named, and in any case $147,000.

Power Co. state that thee repeated
suits are brought with the purpose of
embarrassing as much as possible the
present management, and to get in on a
share of profits made possible by the
railway work being done in Central Ore
gon, lhese officers state that wueu the
of a great loss in the irrigation enter
prise, the Ohio bondholders were not so
eager to establish their claims.
Attorneys and other representatives
of the Ohio bondholders insist that they
put np their money, stood a fair chance
of losing it whea prospects were blue.
and that now they are entitled to con
sideration. Because interest waa not
paij when due, they argue that the
bond claims all fell due, and most be
paid at once.
High School Notes.
The students who are taking the tea
chers' training course have been having
some practical experience during the
past week as thev have had charge of
the third grade while Mies Allen took
the examination. The work done here
shows that the students have profited
by their year's work and that Crook
county is going to reap a great deal of
benefit from this course of the high
school.

Saturday erening. As it was nearing
Valentine Day, the room was artistically
decorateJ with hearts, Cupid's bow and
arrow aud evergreens. Three hearts
were suspended from the folding door
and each guest tried his skill as a
marksman in order to learn hia fate.
Many f pinster and bachelors were re-
coruea as most oi them proved poor
marksmen. Many other amusements
appropriate to the evening were enjoyed
ami in the illustrating contest Misw
Knierien Young won the honors, a beauti
ful va.'entine. The evening's fun closed
with college songa and refreshments and
all said good-night reeling that the clas of
'10 woulvl soon be gone from the C. C. H. 9.
but that it knew how to enjoy life while
it lasted.

The sophomores were initiated into the
mysteries of geometry Monday. They are
late in beginning because of a misunder
standing about their text books.
The juniors 6nished their physio finals
this week aud are anxiously awaiting re
sults. The junior are beginning preparation
for junior day and are planning to make it
more of a feature than did last year' class,
if possible.
