Fined $100 Each
for Illegal Fencing
On January 27 in tbe United States
Court In Tortland, the three Crook
county stockmen, T. J. Ferguson,
J. C. Houston and Elnra Fanght,
llead guilty to the charge of illegal
fencing of government lands and
were fined f 1Q0 each by Judge Can
non. In offering their pleas the defend
ant injected a little humor into the
proceedings by informing the com
missioner that they did not take the
newspapers and had never heard that
anyone had been fined in Oregon lor
surrounding the public lands with
wire fences. The Oregonian says:
Judge Cannon pointed out that
they had profited enough from the'
exclusive nse of the lands to pay
annual subscriptions to the leading
newspapers of Oregon for the rest of
their natural lives, aud Imposed a
fine of 1100 each.
Attorneys for the defendant, after
a consultation with their clients, de
cided not to go to the expense of a
trial of the cases.
The attorneys stated to the court
that the Prineville stockmen then on
trial had erected the obstructions
with knowledge of their unlawful
character, but that they had been
advised by a Prineville attorney
that they would not be arrested or
fined until after the exUeience of the
fences had been discovered and a
notice for their removal bad been
served by representatives of the In
terior Department or the Depart
ment of Justice.
It was asserted that when Special
Agent C. J. Carnahan appeared at
the ranches of the defendants, a
period of 30 days was allowed the men
In which to take down the wires
and poles. Messrs. Houston, Fer
guson and Faught were unable to
produce the written notices to that
effect.
It was pointed out by the District
Attorney for Oregon that no law ex
lute which requires his office to
notify any citizen that he is violat
ing the laws of the land. The ranch
men, who appeared as dofedante,
admitted that they had maintained
the fences without molestation since
1002.
Death of Hon. J. O. Bxth.
Hon. J. O. Booth, brother of W. A,
Booth of this place, died at ii rants
Faiw on January 23, after a lingering
Illness, unconscious of relatives
around him.
The Judge was born In Lee County
Ijwa, in 1S4S, and married Anna
Iebrle at Garden Valley, Douglas
lonnty, ur in in 2. He leaves a
widow and two children, Mrs. Amy
Holmes and John Minor Booth.
Besides these, bis aged father, Eev.
Robert Booth; brothers and sisters,
Mrs. L. T. Keys, Salem; Senator R.
A. Booth and Mrs. 8arah Hockett,
Eugene; J. H. Booth and Mrs. Cora
Singleton, Roseburg; Mrs. Ida Bel
knap, Ashland; Mrs. Bertha Peterson,
Grants Pass, and W. A. Booth and
Mrs. May Toney, of Trine vlile.
Judge Booth went to Grants Pass
in 1SW, and has long been Identified
with the upbuilding of Southern
Oregon. He was a member of the
A-Y-P Fxposition Commission,
was for years connected with
Normal School Board. From
to 1906 he was County Judge,
was a prominent member of
Methodist Church.
The funeral was held last Friday
under the auspices of the Masons.

Nine Pass Eighth
Grade Examinations
Nine eighth grade pupils in the
schools of Crook county passed the
mid-year examinations and are now
eligible to enter high school. Besides
these there were over fifty pupils
in the different schools who nulshed
In the subject of physiology. The
stumbling block In the way of many
seeuied to be the test in spelling.
Several who passed in everything
else fell down when it came to ar
ranging the proper letters in their
proper order in a list of fifty word?.

year for the final eighth grade work,
one In January, one In May and one
In September. Those who failed to
pass this time may try again In May
and In September and thus be able
to take np the high school work
this fall. The mid-year testa usually
have the lesser number of applicants.

opinion of some that we are endorsing "wildcat" schemes
owing to the fact that we had placed on our map which we
have printed on our literature, the names of places not in
existence except in the imaginations of the promoters. We
did this to save answering inquiries as to the location of
