"I hare never sought more than my legal duea in the conflicts had with the irrigation management," said Mr, Drake. I have been called name for trying to prevent diversion of water above Benham Falls and the town of Bend. The company management refer to this act of mine as perfidious, in first selling them a property, and then trying to forbid their fair use of the same. I want to quote paragraph in the agreement made with me when I sold to the com pany, to show that this construction of my course is nnjist. The paragraph is as follows : ' "There shall be no diversion of water from the Deschutes River or any act done by the party of the second part or their assigns, affecting the Bow of water at JUennam talis, or its value a a water power without agreement between the Darties of the second part and the said Drake, or the said C. E. St Wood, trustee, and there shall be no diversion of water above the town of Bend in ex cess of the capacity of the present flume, unless the note herein provided for, in the sum of 1,250, to mature on or be fore January 1, 1903, be indorsed by the said Stanley and Baldwin and Stearns, aa well a by the said Sawhili and iSUndl, at hereinbefore provided." Mr. Drake offers this aa proof that he ha a right to p-event diversion of water above Bend, until he is fully paid, which he says has not teen done. He repudiates any thought of interrupting a public enterprise, save insofar as he has been compelled to, in protection of hit contract rights. Telegram. Oregon Trunk Wins The Oregon Trunk line gained another victory over the Deschutes Railway Company in the contest for Govern ment right of way along the Peeohute river before the General Lnd Dtlloe at Washington City. The platt of the Deechutet or Harri- man road were rejected ior wnai w kuown at section four, embracing the territory between a point 88 mile above the mouth of the lVeechute and a point 130 miles above the mouth. It is the contention of both com- pinies, however, mat in me upper stretches of the Deschutes canyon it is possible to build a railroad on either bank of the river, and inasmuch as the Oregon Trunk line has secured a com plete right of way, it is anticipated that Harriman will be forced to build on the opposite tide of the river unless tne Secretary of the Interior reverse the action of the General Land Office. Examinations for the position of forest ranger on the Deschutes National Forest will be held at Frineville, Ore gon, on uctober -o and M. While the examination is entirely along practical line, and knowledge of field conditions rather than book learn ing ia considered essential, the oppor tunitiea for those applicants with edu cational advantages are considerably in creased. The rapid development of na tional forest is making the continually increasing demand i upon those engaged their management, and men of ability to assume responsibility and serve in supervisory capacities are in de mand. These more responsible po sition on national forests are filled by promotion from lower grades, so that on entering, a ranger is eligible for pro motion to any of the more responsible and higher paid places, including that of forest tnperviaor. Only those men who are at least 21 years of age, not more than 40, of good character, temperate and in gcod physical condition, are eligible to take the examination. The salary paid to beginners is P00 a year. Applicants can secure information concerning tht examination from the District Fores'er at Portland, Oregon, the Forest Supervisor, or the United States Civil Service Commission, Wash ington.
