Referendum Filed
on Beer Ordinance
The referendum petition holding op
the city ordinance recently passed by
the city council prohibiting the sale of
" near beer " has been filed with
City Recorder Shattuek. This petition
was signed several weeks ap but was
not filed until the first of the week.
Thia annuls the law until it is accepted
by a Tote of the citiiens, which vote
will be taken next December.
Speculation is now rife as to w hat is
going to happen in the way of ordi
nances. There is a rumor that the
council will pass another ordinance at
the meeting next Tuesday night.
Others say that the city will tUnd on
the old ordinance which provides for
$500 license. Nobody can be found
who knows what is going to be done
about it. In the meantime the near
beer flows.
Development Work
at Tetherow Bridge
Joseph G. Houston, who is promot
ing the new development company
which is commencing operations at
Tetherow Bridge on the Deschutta, was
in town today and returned to the scene
of work this afternoon. The com pany
haa laid off a tow d site on the river and
has secured the right of way for the
construction of an irrigating ditch w hich
will carry sufficient water to irrigate
about 5000 acres.
This project was at first undertaken
with the idea of locating a Dutch
colony on the land, but negotiations
with the colony people are now nt an
end, and the land w ill be disposed of to
indivilual settlers.
At present the company only has
about 2000 acres in the flat which can
be irrigated, located at the point locally
known as Eddy Flat, the land formerly
being embraced in desert claims taken
by Earl McLaughlin, T. II. Lafollette
and others.
The Spoo eawmill which i being con
structed near the new towmite has not
yet been put in operation, there having
been some hitch in getting the boiler
out from Mmniko. Mr. Spoo is now in
the valley looking after business in con
nection with thft mill.
Paulina Water
Right Case.
Testimony in the case of T. II.
Brennan vs. F. M. and J. L. Smith and
Jbhn Davin, all of Paulina, is being
taken this week before Miss Reulah
Crooks, referee, at W. A. Hell s office.
This tuit was commenced in June
and is for the purpose of deciding a
water controversy for water taken from
Trout Creek in the Paulina val ey. It
includes a question which is now before
the supreme court and which has not
been yet decided, vii: What were the
rights of water users prior to 1877. Mr.
Brennao owns what is known as the
old Charley Elkins place and the suit
is brought to restrain the defendants
from interfering with the flow of water
in an irrigating ditch, which was
established prior to 1877. Mr. Brennan
is represented by Attorney Bell and the
defendants by Attorney M. R. Elliott.

Good News for
May Race Meet.
Encouraging news is being received
almost every day regarding the coming
of race horses for the meeting at the
Fair Grounds (it Frineville in the Utter
part of May. Lee Galbraith has written
that he expects to start from Indepen
dence soon with three racers, "Kam
sack", "Misty Pride" and a two-year-old.
Graffy Baber is coming from Grants
Pass with a string of five.
C. A. Bedell, who is now at Burns,
will be here with "Wade Hampton-'
and to other flyers, which he has
purchased.
"Brandy" will be here from Paulina.
"John II." and "Trump," another
local horse that will be tried out by Bill
Pollard, are now at the track stables in
training for the meet. Judging fiom
the early responses now being received
there will be a dandy lot of racers here
for the spring meet.
