Riparian Rights
Straightened Oat
A dispatch from Salem asys that
the decision of the supreme court
in the Hough-Forter water right
case, from Lake County, will go
far toward clearing the way for ir
rigation enterprises on the Des
chutes River, in Crook county.
There has been more or less un
certainty concerning the irrigation
work in the Deschutes country
because riparian owners have
asserted rights seriously conflicting
with those of the reclamation
companies which had diverted the
water.
While there has been no
litigation attacking the right of
the irrigation company to take all
the water it needed, there has been
uncertanity because of the unsettled
condition of the law as to the
riparian rights. But the decision
of the Supreme Court assures the
reclamation company and the
settlers on its lands that the
owners of riparian lands cannot
cause trouble by insisting that the
water be permitted to flow in the
stream undiminished in quantity

The Deschutes Irrigation and
Power Company diverts water
from the Deschutes river near
Bend. Above that point there are
a number of riparian owners who
have been holding their property
with the expectation that some
time it would be valuable for
power sites. These riparian j
owners have been of the opinion
that they held rights in accordance
with the old common la1 doctrine
of riparian rights which authorized
them to demand that the water be
permitted to flow in its channel
undiminished in quantity. If they
had that right they could compel
the irrigation company to close its
head gates whenever they got
ready to use the water for power.
But the Supreme Court has
decided that the old common law
right does not exist as to lands
disposed of by the Government
since 1877, so that the owners of
the power sites have only such
water rights as they may obtain
by apppopriation to beneficial use,
and their rights are subject to the
rule of priority in time.
All Wter-Ueri Affected.
The decision of the court was
important in many other partic
ulars besides tnat of settling the
dispute regarding riparian rights.
The Hough-Porter ca.e has been
pending in the courts for nine
ysars. Since the suit was started
one litigant died and another is in
the asylum. The parties had been
put to great expense and they had
nostroned improvements because
their rights were uncertain. In
the hope of finally settling the liti
gation, trial Judge ienson or
dered that all water useis or
riparian owners on the stream
Silver Creek, be made parties to
the suit. This was done and 50
parties were brought in. By this
means the Supreme Court has been
able to settle all the water rights
on that stream. It has also estab
lished the practice of making all
persons interested parties to water

right suits, and this practice will
probably be followed in all cases
in the future. Under the decision,
it is within the province of the
court to order that all parties in
terested be made parties, even
if the plaintiffs do cot so desire.
The decision also declares and es
tablishes the right of the court in
complicated cases of this kind to
disregard some of the admission
made in the pleadings if such
admission conflict with the rights
of some of the parties. In other
words, the court, having all tin-
parties before it, will determine
their rights according to the
evidence.
The decision is one of the most
comprensive ever handed down in
this, or perhaps in any state, in a
water right case. Its' broad scope
was made necessary by the large
number of parties with varied
interests.

Cascades near Mount Jefferson and
thence down into the Central
Orecon pra:rie3 to Redmond, the
center of the Deschutes irrigated
district.
"The distance to Redmond, the
objective point of all three lines,
is practically the same by each
route, about 125 milts. The
Shaniko route is probably the
cheapest to build, costing, it is
believed, about $000,000. This
line would not be one of easy
grades, but would go up and down
bill in a way that would make the
profiles resemble the teeth of a saw.
"The line from Portland to
Albany and Detroit and thence
across the Cascades, it is said,
would cost about $2,000,000. It
would be a practicable road, but
would not, it is thought, le equal
to the Deschutes line in a point of
easy operation and few grades.
The Deschutes road is the most
expensive of all to build, costing
not less than 11,500,000.
"The Deschutes route, if followed
will mean eventually a road south
from Redmond toOdell and thence
clear across the portion of the state
lying east of the Cascades to
Ontario, carrying out the original
project of the Oregon Eastern,
surveys for which are alreay on
file in the Ilarriman offices in this
city. If the Deschutes line is
built, it will have an advantage
over any line into the interior
that taps the Southern Pacific,
either from the western or southern
part of the state, because products
hauled out on it will have to find
their market in Portland. If that
district were dni'ied from the
Southern Pacific line entering
Oregon from the south, these pro
ducts might go to tSan Francisco."
