Publiahed Eiw Thursday at the Journal Building, rriuevillo, Oregon THURSDAY, AUGUST 29, 1907 BABY NOW IN COURT Portland Telegram Receiving evidence, document ary and otherwise, that Mrs. Sallie Toruliu is the mother of the 2-year old tot in possession of the woman known as Mrs. Norma Rowlee, and concluding that the latter has de ceived the man she calls tfusband into believing the child their own offspring, with the intention of se curing his money and other pro perty, the Juvenile court has reached out its strong arm and taken possession of the baby. This action was not taken until Judge Arthur L. Frazer, of the Juvenile court, and Deputy Dis trict Attorney Robert Galloway, prosecutor for the tribunal, had personally investigated the affair. Mrs. Tomlin was sent for by Mr. Galloway this morning and was closeted with him and Judge Fraier for some time. Among the documents given them was one signed by Mrs Tomlin and Mrs. Row lee as she is known, dated April 27, 1907, forming an in denture allowing greater latitude taking the child from place to place than was permitted by what purported to be adoption papers, drafted January 26, HXHJ. In this indenture Mrs. Tomlin is admitted to be the mother of the boy known as Orse Carlton Livingston Rowlee. EVIDENCE OF CONSPIRACY The chain of evidence showing the existence of a conspiracy to deceive F. C. Rowlee, superintend ent of the Deschutes Irrigation & Power Company, into believing the child his own son, is thought by the officials of the Juvenile court to be complete, warranting them in taking quick and vigorous action to remove the child from the custody of a woman who is known to have consorted habitually with women of the half-world and is now under indictment on the charge of placing 17-year-old Alice Francis in the disorderly North End establishments of Dorothy Darlington and Essie Watkins. One of the strangest parts of the whole affair, it is said by Mr. Galloway, is the discovery that Rowlee, who is a spiritualist, be lieves that the woman he calls wife is under hypnotic influence, and not responsible for her actions. He adhered to this opinion even after he had seen a letter written by the woman to Alice Francis, in which she said that Rowlee had "gone broke" and that she was very glad of it, and intended leav ing him at once. Information has also' been se cured which will probably result in additional complaints being filed against the Watkins woman and the Rowlee woman. According to the story told Judge Frazer and Prosecutor Galloway this morning by Mrs. Tomlin, the following are the facts in the case: The child known a William Dudley Tomlin and also as Orse Carlton Livingston Rowlee was born to her at the county hospital April 7, 1905 Those in possession ' of the facts as regards the birth are Dr. Uhlman, Dr. Killingsworth, Miss Nathaway, then the head nurse. For certain reasons made known to the court, County Health Officer Dudley Evans has kept the birth certificate in hjs own pos session and did not record it. Mrs. Rowlee induued the mother to let her take the boy when he was six works old and a letter was sent to F. C. Rowlee at Rend, ad vising him of the birth of a child to Mrs. Rowlee. Mrs Rowlee has always come to Portland for three months every spring since then, bringing the child with her and leaving him with a Mrs. Babbitt, on the east side. The mother was induced to sign papers permitting Mrs. Rowlee and her husband to adopt the child in Attorney Moore's office, at Moro, Or., January 2t. HXXi, and it is alleged that Mrs. Rowlee forged the name of the man she calls husband to these papers. Mrs. Tomlin was -led to believe that the child was to be retained only temporarily. Mrs. Rowlee came to Portland and had her sign another paper April 23, last, the witness being M. Esterly, which permitted Mrs Rowlee to take the child out of the state, "Last Thursday," said Mrs. Tomlin, "the woman tried to get me to lead a life of shame. he admitted to me at that time that sh was not married to Mr. Rowlee and said that every time she came to Portland and put my baby with Mrs. Babbitt on the east side she spent her time in disorderly houses here. She said that was where she procured money to give me and to make me presents with. I was also informed by her that Essie Watkins gave her ?300 to take the Francis girl out of Dor othy Darlington's house and place her in the Watkins woman's house. "As soon as I learned this I de manded my baby. She refused to give him to me and said I had signed papers and couldn't get him. So then I plotted to steal him from her, as I had a right to do. I want my boy, and will deny myself everything to feed and cjothe him and give him an education." Probation Officer Sam White, armed with the warrant, issued on complaint of Mrs. Tomlin, served the papers on the Rowlee woman this afternoon. The child is to be placed in the care of Matron Gra ham, at the Detention Home of the Boys' and Girls' Aid Society until the case is .disjosed of. It will come up for hearing before Judge Frazier next Friday. Paulina Notes School Boards and Teachers The attention of school hoard and teachers is called to the follow, ing extracts from the late school law. Teachers, especially, for their own protection should see to it that a copy of their contract is filed in this office. This office will also expect the districts to comply with the law in regard to tUg. Note well the following provisions: The county superintendent shall require teachers In-fore beginning to teach in any school district in his county to register in his office, if they have not previously done so, their county certificates, state paper, and contract, and should any teacher fail to file his or her certificate, state paper or contract in his office before beginning to teach in any district in l is county, said teacher shall forfeit the full amount of salary for the time taught More said certificate, or state paper, or contract was filed The county school superintendent shall notify the clerk of said dis trict of the amount of such for feiture and shall deduct the amount of said forfeiture from the next apportionment due said school district. The requirements of this section shall be enforced only by the county school superintendent of the county in which the school building in which the teicher is employed shall be situated. That the boards of directors in the several school districts of thi state shall procure a United States fiag of suitable size, and shall cause said flan to be displayed up on or near each public school building during school hours, ex cept in unsuitable weather, and at such other times as to said board may seem proper. The necessary funds to defray the expenses to-be incurred for such flags and for poles and appli ances necessary in connection therewith, and for the care thereof, shall be assessed and collected in the Fame manner as the moneys are now raised by law for public school purposes, or tnav be paid out of any funds in the treasury of any school district r.ot otherwise appropriated, lours truly, C.
