HAYWOOD ACQUITTED "Not guilty." This wan the 6nd ing of the jury Sunday morning in the case of the State of Idaho, gainst Wm. D. Haywood, charged with murder in the first degree on account of complicity in the alleged conspiracy which resulted in the death of ex-Governor Frank Steun enberg of Idado. It marked the end of an 80-day trial, upon which the eyen ef the people of the United States have been centered, and was delivered after 21 hours of deliber ation by Inaho's "farmer jury." The courtroom was all but empty when the decision was delivered the noted prisoner, the court and court officials, counsel for both sides and the newspaper men that was all. Rumor had it that a majority of the jury stood for conviction. and verv few knew that the two v members who held out wanted only a conviction in a lesser degree. There was no demonstration. The agreement occured at short ly before 7 o'clock Sunday morn ing, and at 7:10 Judge Wood was notified. It was almost 8 o'clock before the jurors filed in. Havwood had arrived a few minutes before them and had smiled his customary greeting to his coun sel and the newspaper man. As the jury was seated Judge Wood turned to them. "Have you agreed upon a verdict, gentlemen?" he asked. , "We have." responded Foreman Gess, and handed the Judge a plain white envelope. It was empty. "There is. nothing in here," re sponded the Judge in amazement. "That's the rieht envelope in your right pocket," said Juror Rus sell to Mr. Ges, who was palpably nervous. The other paper waa handed up to the Judee. who read it and tossed it to the clerk. "State of Idaho against Wm. D Havwood. We. the jury in the above entitled case find the defend ant not guilty. Judge Wood congratulated the jury and then the prisoner, and then said: "The defendant will be discharged and the jury dismissed for the term." Havwood jumped to his feet upon the announcement of the ver diet. At the close of the Judpe'i remarks he shook hands with each juryman in turn as he filed out Immediately after his release from custody and after he had said good by to those who had been his M low prisoners he walked in com pany witn Attorney Nugent, of his counsel, to St. Luke's Hospital where Mrs. Carruthers, bis mother. is confined. Unannounced, he rushed to her dedside and surprised her with the fact of his freedom 1 he news had a tonic enect upon Mrs. Carruthers, and her condition began to improve almost immedi ately. Moyer Free Once More. Re boy Rv Register Moort'i Son Drown. A dispatch from The Dalle says that on July 25. Ray, 15-year-old son of C. W. Moore, register of the Land Office of The Dalles wa drowned while bathing on the gular dock. He and another wi re divine from the dock. dived, rose twice and was not seen afterward. The body was recovered. Mr. Moore's family consist of a son and dauchter and the loss of boy is a terrible blow to the par ents. The mother is ill with grief. The bov was iust learning to - - . swim and took every opportunity bathe in the river. W. MOORE, Register A dispatch from Boise, Idaho, dated July 30 says: After a delay of nearly 36 hours, Charles H. Mover, President of the Western Federa tion of Miners, was released from the Ada county jail at a late hour to night on a bond of $25,000 sighed by Timothy Regan and Thomas J. Jones of Boise. Moyer will leave for Salt Lake tomorrow night in company with William D. Haywood, who on Sun day was acquitted of the murder of ex-Governor Hteunenberg. After a stop of a few hours in Salt Lake City, they will proceed to Denver, the headquarters of the federation. It was proposed this afternoon to file a cash bond in the eum of $25,000, but the money did not ar rive in time, and rather than allow Moyer to remain another night in jail, his attorney decided, after all, to let a personal bond suffice. Steve Adams, who was expected to be an important witness at the trial, but who was not called by either side, was taken back to Wal lace tonight to await a second trial on the charge of murder there. His first trial resulted in a disagree ment. Formal application was made in the District Court today to have George A. Pettibone admitted to bail.
