In the matter of a change in the
county road as prayed for in the pe
tition of N. A. Ken-bill: Eeport of
viewers showing that petitioners were
not satisfied with the route taken by
said petition it is ordered that no
further proceedings be taken in the
matter and that the same be dismiss
ed; petitioners to pay all costs in the
proceedings.
In the matter of the application of
W. H, Grizzle for cash to prove up on
homestead: Warrant ordered drawn
in favor of J. J. Smith for the sum of

in the matter of the appointment
of a justice of the peace fur Kutcher
precinct: Ordered that U. S. Cowries
lie and he is hereby appointed justice
-for said precinct.
In the matter of the petition of D.
F. Steffi ot al for the antiliuent of the
appointment oi M. c Awbrey as a
member of the election board for
Bend precinct: It appearing from
affidavit of date ot March 3 1902 on
lile in this court, made by M. C. Aw
brey before M. E. Brinit notary pub
lic, that M. C Awbrey is now and has
been a resident of Bend precinct for
past fifteen years, the prayer of D. F.
Steffa et al for his removal is refused.
In the matter of the petition of
Robert Smith for ferry license on the
Deschutes river: Petition refused for
the reason that the land on the west
side of the Deschutes river is vested
in private ownership and that proper
notice was not served. And further
that U. S. Cowle3 by voluntary ap
jwarance ha signified by his petition,
duly presented to this court, that he
desires to avail himself of his right as
owner of the land to establish a ferry
and collect tolls.
In the matter of the report of W.
T. Davenport, road supervisor: Ee
port approved. Supervisor allowed
$fj6 and warrant ordered drawn in his
fi-vor for that amount.
In the matter of the report of Hen
ry Grimes road supervisor: Super
visor allowed $22 and wai rant order
ed drawn in his favor for said amount.
Clerk directed to notify supervisor to
collect delinquent road taxes forth
with by placing the same in the
hands of the sheriff for collection if
necessary.
In the matter of the wrongful as-;
eessment of the Baldwin Sheep 4
Land Co: The Court having uxam
amined the application, but having
been fully advised in the premises by
the attorney for the state, deem the
application should be made to the
sheriff of the county ashy law pro
vided for the relief therein prayed
for, and therefore refuse to act in the
mutter at this time.
In the matter of the application of
V. S. Cowles foi ferry license on the
IHwchutes river: Prayer of petitioner
refused for the reason that this court
lias no jurisdiction overland upon a
government reservation and for the
further reason that Robert Smith by
petition presented to this court hiin-1
