The following case has been
fi led in Marion County Circuit
Court: Joe Lee Russell, Plaintiff
vs. Terry Louis Spradling, Scarlett
Jean Spradling, Harold Edward
Jones, and their heirs, successors,
and assigns. Case No. 21CV35059.
Plaintiff Joe Lee Russell seeks a
judgment declaring him to be the
sole owner in fee simple title of the
real property and all improvements
located at 5686 Battle Creek Road
SE in Marion County, Oregon.
It was the grantors' intent that
Joe Lee Russell and his now-
deceased co-owners own the
subject property with rights of
survivorship and the vesting deed
should be reformed to refl ect that
antecedent agreement. As Joe
Lee Russell is the only owner of
the property left living, he seeks
a declaration that he is the sole
owner of the property in fee
simple, free and clear of any other
claim of ownership.
Defendants, in the name of the
State of Oregon, you are hereby
required to appear and answer
the Complaint fi led in the above
entitled court and cause within
thirty (30) days from the date of
fi rst publication of this Summons.
If you fail to answer, the plaintiff
will apply to the above entitled
court for the relief demanded in
the Complaint. The motion or
answer or reply must be given to
the court clerk or administrator
within 30 days of the date of fi rst
publication specifi ed herein along
