NOTICE OF RECEIVERSHIP
IN THE CIRCUIT COURT OF
THE STATE OF OREGON
FOR THE COUNTY
OF MARION
Case No. 21CV02049
NOTICE OF RECEIVERSHIP
CPIF WTB LLC, a Washington
limited liability company
Plaintiff,
vs.
POD28
LLC,
an
Oregon
limited
liability
company;
HVHOMECENTER
LLC,
an
Oregon limited liability company
Defendants.
To: All Creditors of POD28 LLC
and HVHOMECENTER LLC
NOTICE IS HEREBY GIVEN,
on March 9, 2021, the Circuit
Court of the state of Oregon
for Marion County in the above
captioned case entered an
Order Granting Motion for
Appointment of Receiver (the
“Order”). This Notice is provided
pursuant to ORS 37.330 of the
Oregon Receivership Code.
The Order appoints EHI
LLC through its representative
Edward Hostmann as receiver
(the “Receiver”) over all assets of
POD28 LLC and HVHOMECENTER
LLC (collectively “POD28”), to
serve until further order of the
court for the purposes described
in the Order, including, but not
limited to, taking control of the
receivership estate with the power
and authority to preserve, protect,
and liquidate those assets and
distribute proceeds to the party or
parties legally entitled thereto.
A. Notice of Automatic Stay.
The entry of the Order imposes
an automatic stay against most
collection activities. This means
that creditors generally may not
take actions to collect debts from
POD28 or the receivership estate,
or attempt to exercise control
over assets of the receivership
estate. For example, while the
stay is in effect, creditors cannot
sue, garnish wages, assert a
defi ciency, repossess property,
or otherwise try to collect from
POD28, or from assets of the
receivership estate. Creditors
who violate the stay may be
required to pay actual damages,
costs, and reasonable attorney
fees incurred as a result of the
violation. See ORS 37.220(7).
The terms of the Order also
prohibit POD28, its members,
agents, representatives, and
other interested parties from
interfering in any way with the
Receiver’s custody and control
of the receivership estate, or
taking any actions that would
damage, dissipate, impair, or
prejudice the administration and
preservation of the assets of the
receivership estate.
B. Do Not File Claims at This
Time.
The Receiver has not yet
decided as to whether or not funds
will be available for unsecured
creditors after payment of the
fees and costs of the receivership
and amounts owed to secured
creditors. Therefore, unsecured
creditors do not need to fi le a claim
unless and until you receive further
notice to do so. No claims may be
submitted until a claims process is
fi rst established by the Receiver.
If the Receiver later determines
that there will be assets available
to pay unsecured claims, then
unsecured creditors will receive
further notice of a claims fi ling
deadline and instructions how to
fi le a claim at that time.
