Great American Insurance
Company (“GAIC”) posted
Bond No. 397-89-45-270063
on or about August 3, 2017,
effective for a one year term,
in the penal sum of $50,000
on behalf of Portland City
Motors, LLC, as principal,
payable unto the State
of Oregon as obligee (the
“Bond”) under ORS 822.030.
Pursuant to ORS 822.030(3),
the amount of the bond
recoverable by entities other
than retail purchasers is
limited to $10,000.00. The
Does constitute unknown
individuals who have or may
have claims against GAIC and
the Bond.
Claimants have or may
have claims against GAIC
which in the aggregate
exceed GAIC’s obligations
as surety under the Bond.
GAIC,
therefore,
hereby
makes available under ORS
822.030, as limited by ORS
822.030(3), subject to further
order of the above entitled
Court, the sum of $50,000 or
$10,000 as appropriate per
ORS 822.030, with credit for
the sum of the bond already
paid out to claimants prior to
this lawsuit and the claims
asserted against the bond in
the amount of $27,832.08,
which includes the entire
$10,000.00 payable to non-
retail purchasers and its costs
and disbursements incurred
herein, including service,
publication, and fi ling fees.
This net sum shall be for the
payment to such claimants
who may establish their
claims and may be entitled
proportionately to share in
the aggregate net penal limit
of the Bond.
GAIC prays for exoneration
and discharge with respect
to all of its obligations and
liabilities as surety under the
Bond, to require Claimants,
and each of them, to
interplead and settle among
themselves their rights, if
any, to the net penal limit of
the Bond, and to enjoin and
restrain said Claimants, and
each of them, from making
any claims against GAIC
on account of the Bond, or
from fi ling or prosecuting any
lawsuits or claims against
GAIC on the Bond, except in
this interpleader action.
