Council caves to pressure
on public amenity fund

After numerous discussions during
city council and planning commission
meetings, the city council declined to
approve a program that would have
given city staff the
tools and funding to
begin to reshape River
Road North.
The council took
up the issue for a third
time at the city council
meeting Monday, Oct.
2. The city's planning
commission had rec-
ommended an amend-
ment to the Keizer
development code that
would have required
new and redevelop-
ment of commercial
properties to set aside
1 percent of a project's
total cost to create public amenities.
The amenities could be included in
development plans onsite or the busi-
ness could opt to pay an equivalent
amount into a fund for public art.
While the council approved chang-
es that will require businesses rede-
veloping property interiors to bring
landscaping up to code, the council re-
moved a section of the amendment es-
tablishing the public amenity require-
ment. In lieu of the public amenity
and impact on people and businesses.

The council ended up having the

lic hearings on the
matter. After the fi rst
one in August, the
council directed staff
to draft an ordinance

A Keizer man convicted
of
attempted
aggravated
murder of a Keizer police
offi cer, among other charges,
was sentenced to 25 years in
prison Monday, Oct. 9.
Jose Antonio Hernandez
was found guilty of the
attempted murder, attempting
to elude an offi cer in a vehicle
and on foot, unlawful use of
a fi rearm and being a felon
in possession of a fi rearm by
a jury on Oct. 4. The charges
stem from an incident in
October 2016.
In issuing the sentence,
Judge Channing Bennett
took into account two prior
fi rearm-involved incidents for
which Hernandez served time.
“The reality is that it is
necessary. You make – and I
don't know if this is infl uenced
by the use of drugs and
alcohol – you make some very
dangerous decisions while you
are out,” Bennett said.

No bail for man on 3rd drug arrest

A Keizer man on probation
for drug-related charges for a
second time in less than a year
was arrested on a third round
of drug charges last week.
On Monday, Oct. 2,
Clayton Lee Smith, 32,
arrived at the Keizer Police
Department to turn himself
in to his probation offi cer,

access to his car, but members

Police found 130 grams of heroin in the car of a man turning himself into his parole offi cer.

Unit (CRU) believed they
saw items inside the car that
were evidence of narcotics
crimes.
After obtaining a search
warrant, the vehicle was
searched the following day
and police found 130 grams
of heroin, scales and packaging
materials, $3,500 in cash, a
pistol and three rifl es. One of
the rifl es was determined to
have been stolen.
Smith was charged with
delivery of heroin and parole
violation. He is being held
without bail at the Marion
County Correctional Facility.
It was Smith's fi fth arrest on
drug charges since May 2016,
including two run-ins with
Keizer police in the past year.
On Tuesday, June 27, Smith
was arrested during a traffi c
stop by members of the CRU.
Investigators suspected Smith
had committed several drug
offenses.
