The Trust Deed covers
the
following
described
real property situated in the
County of Marion, State of
Oregon, (“the Property”):
Beginning at a point on the
West line of Lot 1, Block 12,
AMENDED PLAT OF CAPITAL
PARK ADDITION to the City
of Salem, Marion County,
Oregon, at a point which is
100 feet Southerly from the
Northwest corner of said Lot;
thence Easterly, parallel with
the North line of said lot, a
distance of 54 feet to the
East line of said lot; thence
Southerly, along the East line
of said lot, 60 feet, more or
less to the Southeast corner
of said lot; thence Westerly
along the South line of said
lot, a distance of 54 feet to
the Southwest corner of said
lot; thence Northerly along
the West line of said lot, 60
feet more or less to the point
of beginning.
The Grantor or other
person owing the debt has
defaulted as provided under
the Trust Deed, and both the
Benefi ciary and the Trustee
have elected to foreclose
the Trust Deed and sell
the Property to satisfy the
obligations secured by the
Trust Deed.
The default for which
foreclosure is permitted is the
Grantor’s failure to pay when
due the following sums:
Monthly installments of
$523.00 due December 1,
2014, and continuing through
the installment due March
1, 2015, plus unpaid taxes
with interest and penalties, if
any, and for failing to provide
continuous insurance as
required by the Trust Deed.
By reason of the default, the
Benefi ciary has declared all
sums owing on the obligation
secured by the Trust Deed
immediately due and payable
as follows:
$64,771.04 together with
interest thereon at the rate
of 9 percent per annum
from November 18, 2014,
until paid, late charges of
$78.45 as of March 3, 2015,
plus $289.86 for insurance
premium advanced by the
benefi ciary, together with
Trustee’s fees, attorney’s
fees, foreclosure costs and
any sums advanced by the
Benefi ciary pursuant to the
Trust Deed, less reserves and
credits, if any.
NOTICE
The Trustee will on July
30, 2015, at the hour of
11:00 o’clock, A.M., at Front
Steps of the Marion County
Courthouse, 100 High Street
NE, in the City of Salem,
County of Marion, State
of Oregon, sell at public
auction to the highest bidder
for cash the interest in the
Property which the Grantor
had or had power to convey
at the time of the execution
by Grantor of the Trust Deed,
together with any interest
which the Grantor acquired
after the execution of the
Trust Deed, to satisfy the
obligations hereby secured
and the costs, attorney
fees and expenses of sale,
including a reasonable charge
by the Trustee.
NOTICE OF RIGHT TO CURE
The right exists for any
person named under ORS
86.778, at any time that is
not later than fi ve days before
the date last set for the sale,
to have this foreclosure
proceeding dismissed and
the Trust Deed reinstated by
doing all of the following:
1. Paying the Benefi ciary
the entire amount then due
(other than such portion of the
principal as would not then be
due had no default occurred);
2. Curing any other default
complained of herein that is
capable of being cured by
tendering the performance
required under the debt or
Trust Deed; and
3. Paying all costs and
expenses actually incurred
in enforcing the debt and
Trust Deed, together with
Trustee’s and attorney fees
not exceeding the amounts
provided by ORS 86.778.
In construing this notice,
the
masculine
gender
includes the feminine and the
neuter, the singular includes
the plural, the word “Grantor”
includes any successor in
interest to the Grantor as well
as any other person owing an
obligation, the performance
of which is secured by the
Trust Deed, and the words
“Trustee” and “Benefi ciary”
include
their
respective
successors in interest, if any.
