It is the duty of a sheriff or deputy sheriff, or other

cigarette in bis possession to im m ediately inquire where
and of whom he received the sam e, and upon failure of
such person to g iv e in formation when requested by such
officer such m inor shall be gu ilty of a misdemeanor, and
the officer shall, w ithout warrant, arrest said m inor and
