in Malheur county, Oregon, be quieted
in the plaintiff; that the above named
defendants and each of vou, be requir
ed to appear and set forth the nature of
your claim in and to the said land if
any you have, and that all such ad
verse claims be determined by a decree
of this Court; and that by said decree
it be declared and decreed that the
plaintiff is the owner in fee simple of
the said premises and that the said de
fendants have no interest therein, and
that each of the said defendants and
each of the unknown heirs of the said
Elam L. Willey, deceased, be forever
debarred from asserting any claim
whatsoever in or to the said premises
adverse to the plaintiff or his suc
cessors in interest; and for such other
and further relief as to equity shall
seem meet.
You are further notified that this
summons is published once a week for

In the name of the State of Oregon:
You and each of vou, are hereby re-
?uired to appear and answer the In
ormation filed against you in the above
entitled action on or before Tuesday
the 12 day of August 1913. at ten
o'clock A. M. of the said day: and if
you fail so to answer for want thereof
the Plaintiff will apply to the Court for
an Order escheating to the State of
Oregon the funds of the said estate,
viz: the sum of $2335.09.
You will further take notice that this
Summons and following Order is served
upon you by virtue of said Order which
was made and entered by the above
entitled Court on the 24 day of June,
1913, and is as follows:
Whereas, it satisfactorily appears
from the information filed herein that
Daniel Brady, therein named, died in
testate in Malheur County, Oregon, on
or about the 28th day of September,
1908, leaving an estate consisting of
personal property with said County,
and leaving no wife, children or known
heirs at law; and
Whereas it appears from the said
information that the said estate of
Daniel Brady, deceased, was duly and
regularly probated and administered,
and that the personal property was re
duced to money and that the sum of
$2335.09 was obtained therefrom and
turned over to the Treasurer of Mal
heur County, Oregon, and the estate
settled and closed under the said pro
bate Court; and
Whereas it further appears from the
said administration that the said sum of
$2335.09 is subject to escheat unto the
State of Oregon.
Whereas it also appears that the
Governor of the State of Oregon has,
in writing, directed Robert M. Duncan,
as Special Counsel for the State of
Oregon, in connection with W. H.
Brooke, District Attorney for Malheur
County, Oregon, to institute proceed
ings to have said fund escheat to the
State of Oregon, the court being now
fully advised it is therefore
Ordered that the unknown heirs of
the said Daniel Brady, deceased, and
any and all persons interested in the
said estate and fund be, and they are
hereby required to appear iu this Court
on the 12th day of August 1913, and
then and there show cause why the
said sum of $2335.09 should not escheat
unto the State of Oregon.
And it is further Ordered that Sum
mons issue herein and that the said
Summons be served upon J. R. Weav
er, County Treasurer of Malheur
County, Oregon, and that the said Sum
mons together with this Order be pub
lished in the Malheur Enterprise a
newspaper published weekly and of
general circulation in said County for
six consecutive weeks, being seven is
sues, prior to the said 12th day of Au
gust 1913, date of first . publication to
be June 28th, 1913.
