Hall, the brightest Engilish authority
on international law, has thus stated
the matter:
"The principal which haB been
mentioned as being a sufficent test of
the existence of obligatory force or
of the voidability of a treaty at a
given moment may be stated as fol
lows: Neither party to a contract
can make its binding effect depend
ent at will upon conditions other than
those contemplated at the moment
when the contract was entered into,
and on the other hand, a contract
ceases to be binding so soon as any-

time of its conclusion is essentialy
altered.
After citing causes in which treat
ies have been abrogated under similar
circjmstances, Mr. Taylor says:
"The radical change wrought in
conditions existing at the time of the
making of the Hay-Pauncefote treaty
by the transformation of the canal
zone from foreign territory Into do
mestic territory of the United States
beyond all question renders the treaty
voidable' at the instance of the
United States, under the principles of
international law above. Apart from
our peculiar position ana ngnm
under the 'Monroe Doctrine, ' how can
we permit the European powera so
far to interfere with our domestic
affairs as to dictate the regulations
to be made or the tolls to be charged
in a domestic waterway, built within
our own territory? Certainly, no pat
riotic American statesman or pub
licist should ever consent to the sub
mission of such purely American and
domestic interests to the abirtrament
of The Hague tribunal which will
always be dominated by European
iurista naturally hostile to use on
questions of that character.

COMPLETES
LONG TRIP
Greeted by Governor Haw.

nor West to Nynsa was a big day in
the little city. About 20 of the citizens
of that place, all riding horses, met
the governor at 1 o'clock yesterday
afternoon about half way between
Nyssa and Vale and escorted him in
to their city. The whole town was
thrown open and there was a day of
general celebration in honor of the
distinguished guest. A public meet
ing waa held in the opera house, at
which Governor West spoke. He ex
plained his parole system and talked
on irrigation and good roads.
The trip which Governor WeRt has
just completed is said to be the most
unique ever made by any governor
during the time in which he was in
office. He left Salem two weeka ago
and rode, unescorted, across the entire
state, stopping at the towns and cities
along the road, where he preached
good roads and talked on other topics
pertaining to the wellfare of the
citizens of the stats. He rode over
rough mountain traila and across the

journey are inaccessible by vehicles
and are only reached over mountain

Although it was intended that Gov
ernors West and Hawley should ride
together from the state line to Boise,
owing to the injury which Governor
Hawley suBtaindlnan accident several
days ago, it was decided not to take
the horeslaok trip, as planned.
Gov. Weet Enjoit Ride
"I thoroughly enjoyed the trip across
the state, said Governor West last
night. Fatigued from his day'a jour
ney, he went immediately to the home
of Governor Hawley upon hia arrival
n Roise last night. He is being en
tertained by the governor.
This morning Governor West will
attend to his correspondence, which
as been sadly neglected during his
ride across the state. Today ho, to
gether with Governor Hawley, will
visit the state penitentiary, and will
take an automobile trip through Boise
and vicinity, visiting various places of
nterest.
Luncheon will be given at the Com
mercial club Wednesday noon in honor
of Governor West. Governor Hawley
and ex-Governor Brady, as well as
state officials, will be present.

between ranchera and the Vale-Oregon

the clerk's office during the past
week.

Salem, August 1 : A petition from
Edwin F. Treadwell. attorney for the
Pacific Livestock company of Califor
nia, has been received by the state
board of control, requesting removal of
the adjudication of the waters of the
Silvies river in Harney county, from
the state board of control to the federal
court. On the other hand a atrong
protest from the water users' associa
tion of that district has also been re
ceived by the board of control.
For the first time this raises the
question whether the state board of
control is a judicial body, or only ad
ministrative. In the past the board
has been working under the assump
tion that it was only administrative
In which case a petition for removal
of the case would be ignored, but if
the body is judicial then the act of
filing the petition automatically trans
fers the abjudication case to the fed
eral court for hearing. State Engineer
Lewis is looking up the law.
The livestocK company contends a
federal question is involved as it is a
foreign corporation.

the circuit court the past week is that
of Jennie Patch against Glenn Spicer,

The house of representatives on
Monday passed the Borah bill prev
iously passed by the senate directing
that patents shall be issued to home
steaders on Irrigation projecta aa soon
aojthey comply with the requirements
of the law. This will give them title
after three years, instead of waiting
10 and 15 years as under the present
law. Aa the bill passed the provision
requiring the payment of at least 40
per cent of the water charges as a
condition to receiving patent waa
stricken out. The efforta of President
Taft on behalf of this bill aided mat
erially in Its passage.
