The register and receiver of th
Boise land office have handed down
decision in the contest case of Georgt
F. Mahony vs, Walter B. Holman in
volving a desert entry described as th
west half of the northwest quarter
section 33, east half of the northeast
quarter section 32, township 6 south,
range 6 east, in which they hold th
entry for cancellation.
This decision Involves what are de
clared to be "paper water rights" and
the register and receiver say: "We
do not think it was intended that per
sons making entry under the desert
land law should be permitted to pur
chase paper water rights, and on such
showing hold the land indefinitely. The
water right this man purchased was
worthless almost from the time he se
cured it, and in our judgement he should
not be permitted to come in now and '
successfully plead that transaction as
a defense against this contest."
The water right was purchased from
the Bruneau Land and Irrigation com!
pany.
Rode The Rods
As the train pulled into the depot on
New Years morning a knight of the
road was seen to wigglo from the rods.
The morning was a cold one and the
snow was falling fast but the open air
traveller seemed not to be bothered by
the climatic conditions in tho least.

BENEFIT CONCERT
FOR MRS. YOCKEY
A concert will be given as a benefit
for Mrs. Yockey next Saturday, Janu
ary 15, at the Grand Opera house.
The program which is being prepared
will be the very best possible, and some
exceedingly pretty numbers will appear
thereon, while not a weak spot will be
discernible throughout. It has also
been arranged to have moving pictures
thrown on the canvas in the intervals
between the musical items. The
music, vocal and instrumental, will be
carefully selected and the most expert
performers of the city will vie with
some clever musicians amongst the new
comers for honors. It will be the first
time that the latter have been heard in
public here and it is safe to say that
they will acquit themselves so well that
a very pleasant evening is assured.
Vale's own best vocalists and instru
mentalists will also be on their mettle
and something new will come every
moment.
