Present Vault too Small.
Question. Is the Court House and vaults at Vale large enough for the
needs of the county at the present time?
Answer. No. The vault Is very small and Is now full and crowded with
recorda. The taxroll and many of the other records are left out In the open
offices because there is not room for them In the vault. Such recorda might
easily be destroyed If the building should take fire. The treasurer has his
office in the aame room as the sheriff, and In many other ways the building
is to small.
An Expensive Lawn.
Question. How much money has the lawn and trees at the court house
at Vale cost the taxpayer of the county7
Answer. The newspaper in that city claims that It took ten years time
and much expense to grow the lawn ami trees, it Is safe to say that It has cost
$5000.00. With proper soil the same results could be produced In a single
season, and at a trifling expense. Money has paid for wells and gaa engine
pumping plants.
Vale Wants You to Build $200,000 House
Question. If the taxpayers do not accept Ontario's offer to donate a
court house to the county, how long will It be before they will have to pay for
one?
Answer. Probably some one or
Vale think the opportunity Is ripe. They insist that a suitable Court house can
not be built for less than $150,000 to $200,000. Hence when the time comes
the taxpayers of the county can be certain that Vale will attempt to Inflict a
building of that cost upon them.
How Long Will it Last?
Question. How long will the court house which Ontario proposes to
donate be sufficient to accommodate the business of tho County.
Answer. The proposed building Is very substantial, and Is thoroughly
modern and convenient In every respect. It has about twice tho floor space
of the present court house, and several times as much vault room and storage
space. Large and commodlus offices arc provided for each county official. The
building mill be sufficient for all the needs of the county for the next fortv
years.
Not Charity, But Business.
Question, la a town so small and weak that Its very existence depends
entirety upon the location of the county seat therein, a suitable place for a
county teat?
Answer. No. In such a town the value of the county property Is continu
ally decreasing Instead of Increasing There Is no tendency to built up sultablo
and proper accommodations In auch a town for tho benefit of the public having
county business to transact. No town has a right to ask tho taxpayers of the
county to continually prop It up.

Question. Is the attempt of Ontario to procure the county seat an attempt
to ruin and destroy Vale, and la It morally wrong to ask tho taxpayers to make
the removal T
Answer. No. It la purely a matter of business competition between two;
cities. It Is the aame thing as though a new merchant should come to Vale
and open up a store. To a certain extent he would absorb some of the
business of the old merchants, and thereby Injure them; but no one could say
that he waa doing anything wrong, or deny his right to build up a good busi
ness at the expense of the other merchants. The same thing would be true
If another lawyer or doctor should locate in Vale and start to practice.
Ontario has exactly the same right to compete for the county seat. Be
sides the county seat belongs to the taxpayers of the county and not to Vale
or mi other city. When sixty per cent., of the owners destro to remove
the county seat to some other location they have both a legal and moral
right to do so. Those who located In Vale and went Into business there
knew ail of these things, and simply took a business risk and chance on '
the county aeat always being located at Vale. If they failed to rightly judge
the future there Is no one to blame for their poor Judgment; nor can they i
justly ask the taxpayera to leave the county aeat at Vale on that account,
and eventually become taxed for a $160,000 court house to satisfy Vale's
Ideals of a proper court house.
It is Perfectly Legal.
Question. Does the City Charter of Ontario permit the city to erect
a court house and donate the aame to the public?
Answer. The city can legally do this under the powers contained In Its
charter. This charter was legally adopted by vote of the people of the city.
Under it the city council has such powers as are directly given In the
charter, and also auch Implied powers as are necessary to carry Into
effect Its provisions. Section 81 of the Charter provldea among other things
that the Council ahall have power to provide for the erection of a city Jail,
and any other public buildings for the uae of the city or public. It not a
court house a public building for the uae of the public?
The Charter Provision.
Section IIS, of the Charter provldea: "Power and authority la hereby
given to the Council and the said council Is hereby authorised to borrow money
on the faith of the city, to loan the credit thereof, or both, and to that end
to provide for the Issuance of bonds and warrants for any purpose, which.
In the judgment of the council Is beneficial to the interests of said city, and
to designate the manner and time for the payment thereof and the Interest
thereon; etc."

unto Malheur County, a municipal corporation, of the State of Oregon, In
two veers, or as soon as the citizens of
such a sum of money as may hereafter be found necessary to carry out each,
any and all of the promises, convenants and conditions hereinafter Bet forth,
and for the payment of which mild sum of money, well and truly to be made,
wo bind ourselves, our and each of our heirs, executors and administrators,
Jointly, and severally, firmly by these presents;
Sealed with our seals and dated this 19th day of October, 1914.
The condition of thlB obligation is such that whereas the question of the
removal of the county seat of Malheur County, Oregon, from the city of Vnle,
Its present location, to The City of Ontario, has been duly submitted to the
electors of said county by order of the County Court of the State of Oregon
for the County of Malheur, and said question 1b to bo voted upon by
said electors at the next Oeneral Election to be held on November 3rd, 1914;
And whereas, tho said City of Ontario, Oregon, and her citizens promise
and agree to and with said Malheur County, Oregon, and with the public
at largo in said County, that If said County seat of Malheur County
shall be removed to The City of Ontario, Oregon, as a result of said election,
that said City of Ontario, and her citizens, will give and donate to Malheur
County, Oregon, free of any and all charge, the court housn hereinafter
described, together with n suitable and conveniently situated tract of
ground in said city 266 feet long by 250 feet wldo as a slto for said building,
and will also without coat or expense to said county remove all tho records,
files, furniture, jail and fixtures from the present court house of said
county and properly Install tho same In said new court houso building;
And whereas, the said City of Ontario, Oregon and her citizens have
caused to be prepared by Messrs Tourtellotte ft Hummel, architects, of
Boise, Idaho, pictures, plans, specifications and drawings of said proposed
new court house, and have published the same In the newspapers of said
county, and caused tho same to bo circulated among the people generally of
aid county, and a copy of which said pictures, plans, specifications and
drawings are filed with the county crelk of Malheur County, Oregon, to
gether with this bond and undertaking;
And whereas, the obligors herein, desire to guarantee Malheur Count, Ore
gon, and the public at large of said county, that the aforesaid promises and
agreements of The City of Ontario, Oregon, and her citizens, will be well
and faithfully carried out without any expense to Malheur County or tho
taxpayers thereof;
Now, therefore, we, the above named obligors, In consideration of th
promises, and of the benefits thnt will flow to the city of Ontario and to
ourselves Individually by Increased business and enhancement of our property
valuations In Bald city, do hereby Jointly and severally undertake, proinlc
and agree to and with Malheur County, Oregon, and the public at largo in
said count , that If the county sent of said County shall be removed from
Vale 0 Ontario ns n result of the election to be held on said question on
November 3rd, 1914. thnt said . Ily of Ontario, Oregon, and her cltltens upon
Its being definitely and finally determined that said removal Is to bo made,
will Immediately and nt their own expense procure said court house elto in
Ontario. Oregon, and diligently construct, build and finish In a good and
workmanlike manner thereon a new court house building In accordance will,
the said pictures, plans, specifications and drawings as prepared by said
architects and now on file with this bond with tho county clerk of said county
and will thereupon deed and convey said site and anld court house by proper
warranty deed free of all Incumbrances to Malheur County, Oregon, without
price nnd without cost to snld County but as a donation thereto, and will
also upon tho completion of snld building removo all of the rocords, files,
furniture and fixtures and Jail from tho old court house building at Vnle,
Oregon, to the new court house building at Ontario. Oregon and properly In
rtall the same in said new court houso building, ready for the use and occup
ancy of the county officials of said county, all without any cost or expet.se to
snld county but entirely nt the expense of Ontario and her citizens; an ' If snld
city of Ontario, Oregon, and her citizens, shall upon removal thereto of
all tounty seat well and truly keep and perform all ui be promises convi n
ants and conditions sot forth In this undertaking ami ciicninlieiit upon said
city of Ontario I bo kept and performed, thc-i this o ovation shall be void
and of no effect; but otherwise said obligation shall remain nnd be In full
force and effect In law, and Malheur County, Oregon, shall have a good
and lawful right to recover off and from the obligors herein ull cost, expense,
loss and damage to which said county may or shall be put by reason of the
failure or neglect of the City of Ontario, Oregon, and her citizens, to well
and truly keep and perform all of the promises, conveuantH and coudltlouji
Bet forth In this bond and encumbent upon said city to be kept and per
formed. IN WITNESS WHEREOF, we have hereupto set our hands and seals the
