Page 2 June, 1970 The O S E A News Arbitration of Grievances, Disputes Gets OK Use of binding arbitration as a means of settling employe grievances and disputes arising over the in te rp re ta tio n or a pplication of collective bargaining contracts has been endorsed by the state's Per sonnel Division. Arbitration is one of ten “ employment relations" items in OSEA's new, tw o-year bargaining contracts to get the division's approval. A memorandum outlining the items was issued to all state agencies following a series of meetings on the association's new contract among officials of the Executive Department, its Personnel Division and OSEA. "In the Interest of promoting an objective evaluation by negotiators of the proposals being made by OSEA," he said, "th e follow ing factors are suggested as being influential to your determinations as basic management-employe re la tions practices: (1) "Both the state employer and the certified representative of its employes have a duty to bargain in good fa ith .....". (2) "Agreements are subject to the laws of the State of Oregon and rules adopted by control agencies in accordance with legislative direction." (3) "An organization cer tified by the Public Employe Relations Board as representative of employes in a bargaining unit shall be recognized as the exclusive representative of the employes in the unit, and shall represent all of the employes in the unit without discrim ination." (4) "C e rtifie d represen ta tives should be provided payroll deduction of dues and reasonable means for com munication with employes in the unit, including but not limited to such things as lists of employe names and addresses, bulletin board space and access to work areas, when such ac cess w ill not unduly disrupt work activities." (5) "The internal business of the em ploye organization should be conducted during non-duty hours, but th is does include reorganization which would influence the pay, classification, work schedules, geographic locations, etc., of employes. Notice given should provide sufficient time prior to the effective date of the action to p e rm it em ployes' representatives an opportunity to offer their comments." (7) "T h e employe representative should be provided prompt notice of any d is c ip lin a ry proceeding In volving an employe In the unit, and the employe should be n otified of his rig h t to representation in the proceeding." (8) "The Personnel Division endorses a rb itra tio n as a means of settling grievances and disputes where no ex clusive statutory procedure is provided." (9) "The Oregon collective bargaining statutes contain no reference to exclusion of not a c discu ss th e p r o g r a m a n d e le c t tiv itie s , p rim a rily involving collective bargaining, cannot take place during duty hours if recognized as being for the mutual benefit of the employer and employes. Meeting spaces for employes should be made available when their use would not conflict with the business of the employer." These con siderations do not contemplate that all supervisory personnel shall be excluded, nor does it associate exclusion with the part the supervisor may play in a grievance procedure." . These matters are appropriate for agreem ent by colle ctive barga ining . That a m atter might be appropriate for a rule by the Personnel Division does not of itself make the matter non-bargainable." Retirement Boost Subject of Study A seven-point program to improve future and present retirement benefits of Oregon public employes has been adopted fo r study by the Steering Com m ittee of the' Public Employes Retirement Conference. It met In Salem recently to (1) Increasing the em ployer's portion of the pension by adjusting the "fo rm u la fa cto r" from .0067 to .0084. (2) Removal of the 25 and 30 year limitations on the number of years employes are given credit in computing pensions. (3) Use of the highest three (rather than five) years of salary in the last ten years of em ploym ent to compute pensions. (4) A change in the variable a nn uity p ro gram , such as giving employes the option of leaving the program at in tervals, or converting variable fu n d s to t h e " fix e d fu n d " (5) A cost of living increase in benefits fo r those already retired. (6) Im provem ent of the d is a b ility r e tir e m e n t allowance. (7) C orrection of the limitations upon survivorship. Thomas C. Enright, OSEA executive secretary, and Cecil Posey, executive secretary of the Oregon Education Association, were elected co- chairmen of the group.
