JANUARY, 1970 The OSEA News Page 3 OSEA Asks Hospital to Pay 5 Workers 2r 144 Overtime Hours OSEA has asked the Oregon State Hospital to pay five physical plant employees for 2,144 hours o f overtime they worked during the past two years. The overtime claim was filed in behalf of the following employees by staff member Donald A. Beninger: D u a n e L . L o s e k e , maintenance repairman, ’616 hours. Wesley Malby, stationary fireman, 760 hours. Frederick L. Pantle, mainte nance repairman, 144 hours. Cecil L. Plumb, mainte nance repairman 608 hours. Ray F. Thiessen, mainte nance repairman 16 hours. M ost o f th e overtime accrued because each of the men were required to work an eight hour relief shift one day a week in addition to their regular jobs. Beninger said they were paid at a straight-time rate when they should have been paid at the rate o f time and one-half. He asked the hospital to pay the men in accordance with Personnel Division rule 32-800. "Overtime shall be considered as that time worked by an employee in excess of a schedule of eight hours . per day, or 40 hours per week w ithin the basic work week covering the employee," it says. It says compensatory time OSEA has filed a complaint against the Oregon State H ospital charging it with failure to comply with the terms of a collective bargaining contract. The complaint was filed w ith the Public Employe R elations Board by staff" attorney John S. Irvin. It says the hospital must: PERB Turns Down Appeal OSEA's appeal of a Uni versity of Oregon employee's dismissal was turned down by the Public Employe Relations Board at its meeting last month. A la n B e is te l, fo rm e r equipment operator at the UO physical plant, was suspended and later dismissed from his job for misconduct and insub ordination. The action was based upon his refusal to . (1) Post vacant positions so employees w ill have the oppor tu n ity to request assignment to them. (2) Fill vacant positions on the basis of seniority, first w ithin the unit and then w ithin the hospital, provided that employees are qualified to do the work. (3) Give employees the right to request their choice of assignment when the hours o f work or days o ff is to be made w ithin a unit. The hospital said "there was no vacancy to be filled, only an intershift transfer of tw o aides on ward 43. No posting was indicated or made." JONES 'Citizen of the Year' Jones Honored By Community One of OSEA's most well- known members, Chalmers L. Jones, was recently named "A lbina Citizen o f the Year" by the Albina Citizens Council in Portland. ■The council cited Jones "fo r his leadership, devotion and dedication to the com m unity" in presenting the award. A former two-term presi dent of OSEA in 1963 and 1964, Jones has long been active in the association. He has been a member of its Board of Directors fo r several years, and has held office or served as a member of Various state, d is t r ic t and c h a p te r committees. He has been a member o f Oregon's Public Employees' Retirement System Board for several years, and is its current chairman. It said he "was justified only in instituting a grievance pro cedure." It held the action was made in good faith and sustained the dismissal. John S. Irvin, OSEA staff attorney who filed the appeal, argued the dismissal was illegal because it was institutied and signed by J. L. Henshaw, physical plant superintendent. The board found that Jack S te w a rd , UO personnal officer, was the "appointing authority w ithin the meaning of ORS 240.015 and as such was a u th o riz e d and did authorize Henshaw to serve notice of the suspension and dismissal on the appellant." W atch For Y o u r Card This M o n th E v e ry OSEA m em ber should get his 1970 member ship card in about three weeks. T he y w ill be mailed by headquarters the first week in January. Every year approximately two per cent o f the cards are returned because o f incorrect addresses. If you have had a recent change o f address and not notified your chapter s e c re ta ry or headquarters, chances are you w ill not get your card. If it's not delivered by the end of this month, please n otify yòur chapter secretary of headquarters. B u t 262 members le ft state service during December. That left OSEA w ith a net gain o f only 13. Only five o f the associ ation's nine districts ended the month w ith net gains, and they weren't very large. District Six led all districts w ith a net gain of 9. It was followed by Districts Three and Five w ith 8 each. District Eight w ith 5 and District One w ith T. The four districts which re co rd e d net losses were District Nine w ith 9, District Four w ith 4, District Two w ith 3 and District Seven w ith 2. Examination o f the gain-loss column o f the membership report for three o f OSEA's largest chapters pretty much te lls th e story: Corvallis C h a p te r 29 enrolled 24 members but lost 22. Fairview Chapter 57 enrolled 12 and lost 8. OSU Faculty Chapter 72 gained 3 members but lost 7. The membership report puts total membership at 16,419.
