U p to and in clu d in g Ju n e 30, 1951 any
m em ber fo u n d to be in cap acitated , who has
attained the age of 60 (police o fficers or
fire m en , age 55; certifie d teachers, age 50)
shall be granted d isa b ility retirem ent b e ­
nefits com puted on the sam e basis as
service retirem en t b enefits provided in the
act fo r service retirem ent after Ju n e 30,
1951, su b je ct to the $50,000 per m onth
m inim u m d isa b ility retirem ent allow ance.
F o r the purpose o f ca lcu la tin g d isab ility
benefits the term “ his earliest service re ­
tirem ent a g e ” shall be deem ed to be age
60 (polic o ffice rs and fire m en , age 55; cer­
tifica te d teachers, age 50.)
Com pensable in ca p a city shall be deem ed
to b egin at the date th ereo f fix e d in the
report of the ch ie f m ed ical adviser, su b ject
to the app roval o f the board but not in
an y event a n ted atin g the last day for
w hich such m em ber received com pensa­
tion as a p u b lic em ploye.
U nless otherw ise agreed upon betw een
the retirem ent board and the em ployer,
the em ployer shall transm it to the retire ­
m ent board not later th an the 15th d ay
of each m onth the am ount o f em ploye
contributions (payroll deductions) for the
preceding calendar m onth together w ith
corresponding em ployer contributions.
U nless otherw ise agreed upon betw een
the retirem ent board and the em ployer,
the em ployer shall transm it to the re tire ­
m ent board not later th an the 15th d ay of
each J u ly , on form s fu rn ish ed b y the
board, an item ized statem ent o f a ll e m ­
ploye contributions (payroll deductions) fo r
the p receding fis c a l year.

T he fix e d term of an appointive office
is the term fix e d b y statute or m u n icip al
charter.

A p u b lic em ployer entering the system
a fter J u l y 1, 1946 w ill not be charged for
a n y cost estim ates prepared b y the re g u ­
lar o ffice s ta ff of the retirem ent system ,
but shall p ay on ly the cost of estim ates
com puted fo r it in advance b y the a ctu ­

Interest earnings, less deductions p ro ­
vided b y law , shall be added to a ll e m ­
ploye and em ployer accounts at the end
of each fisc a l year, based on the balance
in each account at the end o f th at fisc a l
year.
W hen death, retirem ent or w ith d raw al
o f contributions occurs du ring a period
fo r w h ich no distribution of interest has
been m ade, a m em b er’s interest shall be
prorated for such period on the basis of
the last previous annu al distribution rates
w ith interest added fo r fu ll calendar
m onths only.
