Form er state em ployees returning to ser­
vice w ith an y state departm ent and fo r ­
m er school personnel retu rn in g to school
service w ith a n y p u b lic school district in
this state w ill be deem ed to h ave returned
to the service o f th e em ployer.
The cost o f prior service credit granted
for m ilita ry service sh all be charged to
the state if the em ploye returns to the ser­
vice of the state ,to the school districts of
the state if he returns to the service o f a
school district, or to the p o litica l su b di­
vision b y w h ich he is reem ployed upon re ­
turn fro m service in the arm ed forces.
R u le N o. 6
No em ploye shall h ave m ore than one
m em bership in the retirem ent system even
though he should be sim ultantou sly em ­
ployed b y tw o or m ore em ployers. S u ch an
em ploye m a y not contribu te on th at por­
tion o f his com bined salary in excess of
the firs t $3000.00 per fis c a l year.
A m em ber w hose to tal salary from two
or m ore p articip a tin g em ployers exceeds
$3000.00 per year shall h ave his co n trib u ­
tions deducted b y the several p articip atin g
em ployers fro m the first $3000.00 per year
o f to tal salary . S u c h contributions shall be
deducted in the sam e proportion as the
various salaries paid to him and each em ­
p lo y e r’s con trib u tio n sh all be com puted in
the sam e proportionate m anner. A d ju s t­
m ents necessitated b y contribu tion errors
shall be m ade in the sam e proportion as
the various salaries bear to $3000.00 per
year.
R ule N o . 7
R esp o n sib ility fo r determ in in g th at a p er­
son is enrolled fu ll tim e in a state in sti­
tu tion p rin cip a lly fo r the purpose of lea rn ­
in g , as p rovided in section 8, subsection 5,
shall rest upon th e g o vern in g a u th o rity
o f the in stitu tio n in w h ich the person is
enrolled.

certified to the board.

L iv in g quarters, board, lod gin g, fu e l,
lau n d ry and other advantages fu rn ish ed an
em ploye shall be tak en into account o nly
as certified to b y the em ployer and shall
be valu ed fo r salary contribution purposes
in the sam e m anner and for the same
am ount as such advantages are v alu ed b y
the State T a x Com m ission fo r incom e ta x
purposes.
In no case shall such account in clu d e
item s o f travelin g expense or other e x ­
pense paid b y an em ploye w h ich is su b ­
je c t to reim bursem ent.
R u le N o. 11
A cce p ta b ility of the an n u ity w hich an
em ploye has alread y com m enced to p u r­
chase, as provided b y section 8, subsection
9, shall be determ ined b y the retirem ent
board.
A d e q u a cy o f the b enefits affo rd ed b y the
contract fo r such an n u ity shall be d eter­
m ined b y the em ployer.
The retirem ent an n u ity provided b y the
fed eral retirem ent system is considered as
an acceptable an n u ity fo r an em ploye p a r­
ticip a tin g in th at system and desiring to
be exem pted from co ntrib u ting to the p u b ­
lic em ployes’ retirem ent fu n d , provided
the fed eral an n u ity is adequate in am o u n t.
In a ll cases, the agreem ent fo r su b sti­
tution of an an n u ity m ust be execu ted b y
the em ploye, his em ployer and the P u b lic
Em ployes R etirem ent B o ard .

(Portland) are m em bers of th at system and
ineligib le for m em bership in the P u b lic
Em ployes R etirem ent System .
R u le N o. 13
In determ in in g w h eth er or not a person
w as or is an em ploye of a p articip atin g
em ployer, the retirem en t board w ill co n ­
sider the fo llo w in g facto rs:
1. W ho has had the au th o rity to select
and engage the em ploye.
2. W ho had or has the pow er of dism issal.
3. W ho had or has the au th o rity and re ­
sp o n sib ility fo r d irectin g and su per­
v isin g the e m p lo y e ’s w ork and for con­
tro llin g the e m p lo y e ’s conduct at w ork.
4. F ro m w hom did or does the em ploye
receive h is com pensation.
In order fo r an em ploye to reduce his
contribution rate to 5 per cent, w h ich m ay
