ernor. A ll hearings shall be open to the
p u b lic. Tw o m em bers shall constitute a
quorum fo r the transaction o f business.
2. W ithin 90 days after the appointm ent
of the com m ission and th ereafter w ithin 40
days after a v acan cy occurs in the o ffice o f
director, the com m ission shall conduct a
com petitive test for the position of director
and shall th ereafter select and appoint a
director.
3. The m erit system director shall be in
the classified service and shall have had
experience in the fie ld o f m erit system p er­
sonnel adm inistration and be fam iliar w ith
its principles and m ethods. H e shall hold
no other p u b lic o ffice or em ploym ent, pro­
vid in g, how ever, th at fo r the duration of
the present w ar -he m ay be a p art-tim e
em ploye.
4. The com m ission shall, not later than
Ju ly 1, 1945, appoint a provisional m erit
system director whose qualifications shall
be determ ined b y the com m ission to be the
qu alificatio n specified herein, to serve u n ­
til such tim e as a regular appointm ent can
be m ade.
5. The com m ission m ay rem ove the d i­
rector fo r cause, but before ta k in g such
action it shall first give to the director a
statem ent in w riting of its intention to e f­
fe c t his rem oval and the reason therefor.
A n y tim e w ithin fiv e days after receipt of
such statem ent in w riting, the director m ay
appeal in w riting to the com m ission for
investigation and review . W ithin 40 days
thereafter, the com m ission shall render its
decision w hich shall be b inding and fin a l.
6. The com m ission shall em ploy such as­
sistants to the director as appear necessary
and shall, w ith the approval of the budget
director, f ix salaries for each, in clu d ing the
director, providing, how ever, that such
salaries and positions shall conform to the
classifications and p ay plan provided b y
this act w hen adopted.
7. The com m ission m ay designate an
em ploye of the departm ent as deputy, to
act as director w hen the director is unable
to act.
Section 7. The com m ission shall adm in­
ister the state departm ent o f c iv il service;
m ake necessary investigations of the p er­
sonnel adm inistration; review any action
by the departm ent w hich m ay appear to be
arbitrary or ille g al; and m ake annual re ­
ports and special reports as necessary to
the governor regarding personnel adm inis­
tration in the state service and recom m en­
dations fo r im provem ent therein.
The com m ission assisted b y th e director,
shall m ake such rules as m ay be necessary
and consistent w ith this act. A n y rule so
adopted shall be file d w ith the secretary of
state as provided in chapter 5, title 89,
O .C .L .A ., as am ended, and shall becom e
effectiv e 10 days after it is filed .
Section 8. The director, su b ject to the
approval o f the com m ission, shall direct
and supervise all the adm inistrative and
tech nical activities o f the departm ent. In
addition to the duties imposed upon him
elsewhere in this act, it shall be his d u ty:
1. To attend all m eetings o f the com m is­
sion and to act as its secretary and keep
m inutes o f its proceedings.
2. To establish and m aintain a roster o f
a ll em ployes in state service, in w hich
there shall be set forth , as to each em ­
ploye, the class title o f the position held;
the salary or p ay; any change in class
title, p ay, or status, m erit rating, and an y
other data the com m ission deems necessary.
3. To select for appointm ent, under the
provisions o f this act, such employes of the
departm ent and such experts and special
assistants as m ay be necessary to carry out
e ffectiv e ly the provisions o f this act.
4. To prepare, in accordance w ith the
provisions o f this act and the rules adopted
thereunder, appropriate tests, rating o f ca n ­
didates for appointm ent, and eligible lists.
5. To m ake certifications fo r appointm ent
w ithin the classified service, in accordance
w ith the provisions o f this act.
6. To devise plans fo r and cooperate w ith
appointing authorities and other su pervi­
sory officers in the conduct o f em ploye
train in g program s to the end th a t the
q u ality of service rendered b y persons in
the state personnel m ay be continu ally im ­
proved.
7. To investigate from tim e to tim e the
operation and e ffe ct of this act and o f the
rules and to report his find ings and recom ­
m endations to the com m ission.
8. To m ake annual reports to the com ­
m ission regarding the w ork of the* depart­
m ent, and such special reports as are con­
sidered desirable to the com m ission.
9. To select, w ith the approval o f the
com m ission, officers or em ployes in the
state service to act as exam iners in the p re­
paration and rating o f tests. A n appointing
au th ority shall excuse an em ploye in his
division fro m his regular duties for the
tim e required for his w ork as an exam iner.
O fficers and em ployes shall not be entitled
to extra p ay fo r their service as exam iners,
but shall be entitled to reim bursem ent for
necessary travelin g and other expenses.
Section 9. Su b je ct to the rules of the
com m ission, a division m ay designate a
sta ff em ploye to serve as division person­
nel o ffice r. It shall be the responsibility o f
such divisional personnel officers to ad m in ­
ister w ithin the division, train in g and edu­
cational program s developed b y the d irec­
tor in cooperation w ith appointing a u th o ri­
ties and others; and to sim ilarly adm inister
such responsibilities and functions o f the
departm ent as are authorized b y the com ­
m ission or director.
Section 10. The u nclassified service shall
com prise the positions o f:
1. O fficers elected b y popular vote and
persons appointed to fill vacancies in elec­
tive o ffices.
2. M em bers o f boards and commissions
and heads o f departm ents required b y law
to be appointed b y the governor or the
board o f control.
3. One execu tive o ffice r and one secre­
ta ry fo r each board or com m ission, the
m em bers o f w hich are elected officers, or
are appointed b y the governor or the board
o f control, excep t the c iv il service com m is­
sion.
4. One p rincipal assistant or deputy and
one private secretary fo r each elective e x ­
ecutive or adm inistrative o ffice r, and fo r
each execu tive or adm inistrative o ffice r re­
quired b y law to be appointed by the g o v­
ernor or the board o f control.
5. Em ployes in the governor’s o ffice and
the p rincipal assistants and private secre­
taries in the secretary o f state’s devision.
6. Ju d g e s, referees, receivers, court re ­
porters, b a iliffs, officers o f the court, ju ro rs,
and notaries p u b lic.
7. O ne secretary or clerk o f each ju d g e
o f a court o f record.
