p erson nel adm in istration fo r th e c iv il s e r
v ic e o f th e state; p ro vid in g penalties, and
p ro vid in g a sav in g clause, and a p p ro p ri

State of Oregon:
S ection 1. Th is act sh all be kn o w n as th e
“ S ta te C iv il S e rv ic e A c t.”
S ection 2. T h e g en eral p urpose o f th is act
is to establish fo r th e state a system o f
p erson nel adm in istration based on m e rit
p rin cip les and sc ie n tific m ethods, g o vern in g
th e appointm ent, prom otion, tra n sfer, la y
off, rem o v al and d iscip lin e of its o ffice rs
and em ployes, and oth er in ciden ts o f state
em ploym ent. E x ce p t as h e re in a fte r sp e ci
fied, a ll appointm ents and prom otions to
positions in th e state se rvice sh all b e m ade
on th e basis o f m erit and fitn ess, to b e a s
certain ed b y co m p etittive exam inations.
S ection 3. A s used in th is act, u nless th e
co n te x t c le a rly req u ires oth erw ise:
1. “ D ep artm en t” m eans th e d ep artm en t of
c iv il service.
2. “ D ire cto r” m eans th e m erit system d i
rector.
3. “ C om m ission” m eans th e c iv il se rvice
com m ission.
4. “ S tate s e rv ic e ” m eans a ll o ffic e s and
positions in th e em p loy o f th e state, oth er
th an th e m ilita ry and n a va l services.
5. “ A p p oin tin g a u th o rity ” m eans an o ffi
ce r o r a g e n cy h a v in g p o w e r to m ak e a p
pointm ents to positions in th e state service.
6. “ D ivisio n ” or “ D ivision o f th e s e r v ic e ”
m eans a state d ep artm en t or a n y d ivision
or b ran ch th ereof, or a n y a g e n cy o f th e
state governm ent, or b ran ch o f th e state
service, a ll th e positions in w h ich a re u n
der th e sam e ap p oin tin g a u th o rity.
7. “ C lass” or “ Class of p osition s” m eans
a grou p o f position s in th e state classified
se rv ice s u ffic ie n tly a lik e in duties, a u th o r
ity and resp on sib ilities th a t th e sam e q u a li
fic a tio n m a y reaso n ab ly be req u ired for,
and th e sam e sch ed u le o f p.av can be
e q u ita b ly ap plied to, a ll positions in th e
group.
8. “ E n tran ce te st” m eans a test fo r p osi
tions in a p a rtic u la r class, adm isison to
w h ich is not lim ited to persons em p loyed in
th e state service.
9. “ P rom otion te s t” m eans a test fo r p osi
tions in a p a rticu la r class, adm ission to
w h ich is lim ited to em ployes in th e cla ssi
fie d se rv ice w h o h a v e h eld a position in a n
oth er class fo r a p eriod o f not less th an six
m onths.
10. “ E m p lo ym en t lis t” m eans a list of
persons w ho h a v e b een fou n d q u a lifie d b y
an en tra n ce test fo r ap poin tm en t to a p osi
tion in a p a rticu la r class.
11. “ P rom otion lis t” m eans a list o f p e r
sons w ho h a v e b een fou n d q u a lifie d b y a
p rom otion test fo r appointm en t to a p osi
tion in a p a rticu la r class.
12. “ R eem p loym en t lis t” m eans a list of
persons w ho h a v e b een re g u la r em ployees
in a p a rticu la r class and w ho are en titled
to h a v e th e ir nam es c e rtifie d fo r ap p oin t
m ent to a position in th a t class.
13. “ L is t” m eans an em ploym en t list, a
prom otion list or a reem p lo ym en t list.
14. “ E lig ib le ” m eans a p erson w h o se nam e
is on a list.
15. “ R e g u la r em p lo y e ” m eans an em ploye
w ho h as b een appointed to a position in
th e cla ssified se rv ice in a ccord an ce w ith
this act a fte r com p letin g his tr ia l se rvice
period.
S ection 4. T h e re sh all b e in th e state
govern m en t a d ep artm en t o f c iv il service
w h ich sh all be g overn ed b y a c iv il se rvice
com m ission o f th ree m em bers.
S ection 5. T h e m em bers o f th e com m is
sion sh all b e citizen s o f th e state kn ow n
to b e in sym p ath y w ith th e ap p lication of
m e rit p rin cip les to p u b lic em p loym en t and
o f reco gn ized standing and kn ow n in terest
in p u b lic ad m in istration and in th e d e v e l
opm ent of e ffic ie n t m ethods of selectin g
and ad m in isterin g p ersonnel. No m em ber
o f th e com m ission sh all hold, or be a can
did ate for, a n y p u b lic o ffice. No person
sh all b e appointed as a m em b er o f th e
com m ission w ho has h eld an e le ctiv e p u b lic
o ffic e or an a p p oin tive p u b lic o ffic e o f a
p o litical natu re, or position in a p o litical
p a rty, w ith in six m onths im m ed ia tely p r e
ced in g his appointm ent. No m em b er o f th e
com m ission sh all h a v e b een an em p loye of
a n y o fth e d ivision s w ith in one y e a r p rior
to his appointm ent.
T h e m em bers o f th e com m ission sh all be
appointed b y th e govern or, and th e first
m em bers sh all be appointed w ith in 10 days
a fte r th e e ffe c tiv e date o f th is act. O f th e
m em bers firs t appointed, one sh all be a p
p oin ted fo r a term end in g June 30, 1948,
one fo r a term en d in g Ju n e 30, 1949, and
one fo r a term end in g Ju n e 30, 1950. T h e re
after, each m em b er sh all b e appointed fo r
a term end in g th re e y e a rs fro m th e date o f
th e ex p ira tio n of th e term fo r w h ic h his
p red ecessor w as appointed, e x c e p t th a t a
person appointed to fill a v a c a n c y occu rrin g
p rio r to th e ex p ira tio n o f such term shall
b e appointed fo r th e rem ain d er o f th e term .
E ach m em b er o f th e com m ission sh all hold
o ffic e u n til his successor is appointed and
q u alifies.
M e m b e rs. o f th e com m ission sh all re ce iv e
no sa la ry b u t sh all b e p aid a p er diem of
ten dollars ($10) fo r each d a y or portion
th e re o f th a t th e y a re n ecessarily ’ in session
fo r th e tran saction o f business of th e com
m ission. T h e y sh all also b e reim b u rsed fo r
n e ce ssary tr a v e l and oth er exp enses in
cu rred in th e p erfo rm a n ce o f th e ir duties
in a ccord an ce w ith state p ro ced u res and
p ractices.
A m em b er of th e com m ission sh all b e r e
m o va b le b y th e g o vern o r o n ly fo r cause,
a fte r b ein g g iv e n a cop y o f ch arges again st
him and an op p ortu n ity to b e h eard p u b
lic ly on such ch arges b e fo re th e g o v e r
