MEETING: Special Tribal Council

Chairman, Delores Pigsley, calledthe meeting to order, 9:05 a.m.
Roll call was taken, with 8 Council Members present and 1 absent.
Douglas entered the meeting at 9:20 a.m. The Special Council
Meeting was called to discuss whether or not we would be.able to
fund the Portland Area Office and the effects of the 15% indirect
rate on our programs. Phil sent a memorandum to the Council out­
lining possible changes. Phil reported in F.Y. 1987 we will receive
100% funding, but in 1988 the 15% indirect rate will probably go in­
to effect. The memo was based on tw o assumptions: 1) funding
would be at 100% level; and, 2) 15% indirect rate will be in effect
for F.Y. 1988. Phil took the base amount, minus the $131,900 in­
direct which was grandfathered in F.Y. 1984 and 1985, minus the
grants. Direct cost left would be $545,588. The net result would be
a $52,000 shortfall in indirect in F.Y. 88. Phil also believes we will
have a shortfall of $24,000 in F.Y. 1987. Utilities, janitorial services,
rents, and other things will have to be charged to programs to cover
these costs now paid by indirect. Phil noted that if the BIA imposes
a 15% indirect rate, ther is a good possibility that IHS will also.
MOTION #1 — Bud Lane moved to enter Executive Session to
discuss Personnel and Budgets, 9:12 a.m. Seconded by Dolly
Fisher. Motion approved, 8-0-0. .
MOTION #2 — Frank Simmons moved to return to Regular Ses­
sion, 12:35 p.m. Seconded by Lori Johnson. Motion unanimously
approved, 9-0-0.
Dee requested that Phil have ready by the December 9th meeting
the Head Start statistics and alternatives for rebudgeting, staffing
patterns, suggested cuts for indirect staff and goals for JTPA.
Council also wants to review staff evaluations. Dee requested infor­
mation on positions paid out of timber revenue. Since they are look­
ing at staff cuts for programs they should be looking at trimming
the budget and staff in timber as well. They want Phil to hold up on
all vacancies pending reorganization of staff. Dee directed Phil to
sign the Portland lease but try to commit to less than 3 years.
Phil reported the Core Management Grant was sent to the Council
for their review. It was written by Darlene Carkhuff and Tina Jones
and reviewed by Frank Petersen, Phil Rilatos and Judy John. It is to
purchase microfiche equipment and a paper shredder. The only ma­
jor change from the draft sent to Council was placing a microfiche
Reader/Printer in the Portland, Salem and Springfield area offices
instead of just a Reader. Total budget is $19,100. Phil thinks we
have a good chance of getting funded for the project, especially
since we are running out of space for our files.
MOTION #3 — Dolly Fisher moved to approve submission of the
Core Management Grant to the Bureau of Indian Affairs. Seconded
by Frank Simmons. Motion unanimously approved, 9-0-0.
Phil reported the Federal Government has changed their mileage
reimbursement raté to 20.5 cents per mile. We need to change ours
or our staff will have to pay income tax on the difference.
MOTION #4 — Dolly Fisher moved to change the mileage reim­
bursement rate to 20.5 cents per mile, effective December 1,1986.
Seconded by Bud Lane. Motion unanimously approved 9-0-0.
Phil presented a resolution, drafted by Mary Lane, regarding the
JTPA Performance Standards. A letter on the same subject was
sent to Roger Semerad and asked that the performance standards
be implemented on a trial basis only, and asked that we be one of
the test sites. This resolution supported the letter. Dee read the
resolution.
MOTION #5 — Bud Lane moved to approve the Resolution recom­
mending the JTPA Performance Standards be implemented on a
trial basis only without penalty to Indian Grantees. Seconded by
Lori Johnson. Motion unanimously approved, 9-0-0.
Phil reported he received a call from George Towner. He is han­
dicapped and would like the Grounds Crew or Maintenance to put
up a trailer skirting on his trailer and check his water tank. He has no
family " member that can help. Council did not object to the
Grounds' Crew helping if there are no JTPA regulations against it.
Bud noted that IHS was going to assist w ith his water tank but
there was confusion about his needing an agreement to allow him
to live on the premises for a minimum o f 10 years. Council discuss­
ed the "Help the Elderly" Program. W e need to enlist the help of
volunteers to help with handicapped and elderly tribal members.
Council asked Tina to put an article in the Tribal Newsletter and
area newsletters requesting volunteers to visit elders, visit shut ins,
assist in gathering firewood and light maintenance work.
Phil reported that about 1 % cords of firewood was stolen from
Government Hill. This wood was designated for elders. Alta asked
about firewood for Salem area residents. Bud noted that the Timber
Committee looked into hiring someone to cut and haul wood for the
elderly, but found it was cheaper to buy wood than to have so­
meone cut and haul it. Mary Alice noted you needed a PUC Permit
to haul w ith a commercial truck. Rank felt that if you buy wood for
some, others would want their gas or electricity paid for. Dee noted
that those on SSI would have to claim free wood as income. Coun­
cil discussed setting aside a day to cut the wood on Government
Hill, stacking it and distributing it to elders and handicapped tribal
members. Lori felt the Council should set a good example and get
things started. Tentatively, Council w ill cut and stack wood on
December 6th, from 9:0 a.m. -11:00 a.m. Mike will keep track of the
wood and issue permits. Volunteers are needed to transport wood
to Salem and Springfield areas, as well as needy elderly and han­
dicapped tribal members. Dee asked Tina to place a notice in the
area newsletter, once the Timber Committee gives their approval.
MOTION #6 — Bud Lane moved to enter Executive Session to
discuss Land Acquisition, 1:25 p.m. Seconded by Alta Courville.
Motion unanimously approved, 9-0-0.
MOTION #7 — Bud Lane moved to return to Regular Session, 1:43
p m. Seconded by Frank Simmons. Motion unanimously approved,
90-0.
Dee asked that Council be mailed a copy of all they have approved
from the Tribal Council/Tribal Government and Maintenance
budgets. They want to see the total amount they have committed
so far.
TRAVEL REQUEST — Bud, Phil, Dee and Dolly are asking for out-
of-state travel approval to attend the Affiliated Tribes meeting in
Bellingham, Washington.
MOTION #8 — Alta Courville moved to approve out-of-state travel
for the following: Bud Lane, Phil Rilatos, Delores Pigsley and Dolly
Fisher to Bellingham, Washington on December 12th. Seconded by
Douglas Brown. Motion unanimously approved, 9-0-0.
Lori discussed IHS not paying bills on time and some people have
been turned into a credit bureau. Some tribal members do not
realize they need to turn in their bills to IHS as soon as the doctor
bills the tribal member. Dee suggested that these people contact
IHS and ask IHS to call the doctors or bookkeepers and explain the
billing process.
Frank Simmons said he feel that Veterans would like the Marker
placed at the bottom of the hill instead of outside of the Council
Chambers. Dee asked Tina to put an article in the area newsletters
requesting input from tribal members on where they would like the
Memorial Marker placed.
Dolly reported that Art's term to the Commission on Indian Services
Board expires in December. She would like to have him considered
to fill this position again.
MOTION #9 — Dolly Fisher moved to re-appoint Art Bensell to the
Commission on Indian Services as the Tribe's delegate. Seconded
by Bud Lane. YES: Lori Johnson, Frank Simmons, Douglas Brown,
Bud Lane, Delores Pigsley, Dolly Fisher, Alta Courville. NO: None.
ABSTAIN: Mary Alice Muncey, Art Bensell. Motion approved,
7-0-2.
A discussion was held on a gift for Governor Atiyeh. It was sug­
gested a placque of some sort be made to honor him for his help
and support to the Siletz Tribe.
December 16th will be a signing ceremony with Governor Atiyeh.
He will be signing the State/Tribal ICWA Agreement. Council asked
that Kristi Martin be there to take pictures for the Tribal Newsletter.

MOTION #1 — Frank Simmons moved to approve the agenda.

MOTION #2 — Dolly Fisher moved to approve the minutes from the
11/22/86 Special Council Meeting. Seconded by Rank Simmons.
Motion approved, 8-0-0.
MOTION #3 — Bud Lane moved to enter Executive Session to
discuss Personnel, 6:05 p.m. Seconded by Dolly Fisher. Motion ap­
proved, 8-0-0.
MOTION #4 — Frank Simmons moved to return to Regular Ses­
sion, 7:37 p.m. Seconded by Lori Johnson. Motion unanimously ap­
proved, 9-0-0.
Bonnie Petersen reported the Siletz Ladies' Club had raised $87.50
from their raffle, and $32.00 from selling fry bread. They requested
using $32.00 for the Ladies' Club and putting the $87.50 into the
general fund for the Povy-Wow. Council agreed to this. They re­
quested approval to sell fry bread or Indian tacos and hold a raffle
during the next General Council Meeting to raise half of the money
Delbert Bell needs to accompany A rt Bensell to Kansas when Art is
inducted in the Indian Athletic Hall of Fame. The other half would
remain w ith the Siletz Ladies' Club. Council agreed, but the Ladies'
Club needs to check with Sacred Lands Reservation Committee,
who may also be doing some fund-raising then, so there is no con­
flict.
Bonnie reported on the self-assessment for the Head Start Rogram.
There were 15 people working on several categories, including
Health, Nutrition, Social Services and Parent Involvement. Out of
the hundreds of areas assessed, there were only 23 items out of
compliance. Most of these were being performed, but not docu­
mented well enough and have been taken care of already.
Rosemary indicated the SAVI Correction Action Plan would take
care of the remaining items out of compliance.
Rosemary presented the Parent Involvement Rogram grant ap­
plication. The purpose is to get parents actively involved with their
children in Head Start. The grant amount is $25,000, and would pay t
for a part-time Parent Involvement Advocate position, preferably a
teacher or Social Service person.
MOTION #5 — Alta Courville moved to approve submission o f the
Head Start Parent Involvement Rogram appplication for $25,000.
Seconded by Lori Johnson. Motion unanimously approved, 80-0. .
TRIBAL ATTORNEY'S REPORT -
LeRoy noted that the
State/Tribal ICWA agreement was finalized and the Governor will
have a signing ceremony on December 16th. The Tribe needs to
formally approve this agreement before then. LeRoy reviewed the
agreement w ith Council. Most importantly, the Agreement gives
the Tribe and the State avenues to share information and coopera­
tion and reinforces provisions of the Indian Child Welfare Act.
MOTION #6 — Delores Pigsley moved to approve the State/Tribal
ICWA Agreement. Seconded by Alta Courville. Motion unanimous­
ly approved, 9-0-0.
LeRoy requested a special meeting w ith the City to discuss the
Water/Sewer agreements for the HUD homes. Phil will check into
this. LeRoy presented a chart showing options the Council could
take w ith revenues it could receive from the privitization method.
No options were chosen and Council agreed a special meeting was
needed to discuss these options. This meeting has been set for
January 3 - 4, 1987, in Portland.
GENERAL MANAGER'S REPORT — Phil reported the Tribe did not
get notice to proceed with the F.Y. 1987 HIP Program. He has stop-
ped the HIP program until we get notice. It is rumored the Bureau
will not make this program retroactive to October 1st. He has in­
structed the Business Manager to assume these duties for now. He
is requesting a resolution altering the required 30-day notice to lay
off tribal employees due to lack of funds in this program. Dee felt
we should give a 30-day notice to all program staff prior to the next
fiscal year to avoid this problem, W e never know when or if we will |
get Bureau funding for our programs. Dolly noted we need to finish ’
using F.Y. 86 funds before we will get F.Y. 87 HIP funds.
MOTION #7 — Alta Courville moved to waive the 30-day notice of
lay-off under the provisions of the Personnel Policies and Pro­
cedures Manual, Section 629.5, for the HIP Coordinator due to the
lack of funds. Seconded by Douglas Brown. Motion unanimously
approved, 9-0-0.
Phil received a letter from Gary Snyder regarding his father's pro­
perty. They are willing to work with the Tribe in getting an ease­
ment or sell this property for assessed value so the Tribe can have
access to the Harney-Evans-Baker Cemetery. Phil will send th e m i
copies of the maps and survey. Dee felt they may grant a right-of-
way if the Tribe agrees to keep the access clear. Dee suggested we
ask if Gary can come down and walk the route w ith Phil to see if it is
agreeable with them.
The Salem USDA warehouse must be moved or they will not
deliver our January shipment. W e cannot wait for an answer from
Van Peters on using a Chemawa building. Council decided to move
the warehouse to South Beach for now.
Phil requested a decision on which option the Council would like on
rebudgeting and staff changes as discussed in Executive Session.
MOTION #8 — Delores Pigsley moved to adopt Option #2 for in­
direct cost purposes and budget revisions and change in staff in
order to staff the Portland Area Office, and to abolish the CHR posi­
tion in Springfield, contingent upon approval of the F.Y. 1987 IPS
reprogramming. Seconded by Lori Johnson. Discussion held.
Douglas asked if abolishing the CHR position would be necessary if
one of the CHR’s was hired in the SIHA position. It was felt it might
change it, but we need tw o CHR's in Siletz anyway. Douglas asked
who the Springfield tribal members contact in emergencies. They
can contact Alice Werth for transportation, or any emergency
medical facility in the area. YES: Lori Johnson, Frank Simmons,
Douglas Brown, Delores Pigsley, Mary Fisher, Art Bensell, Alta
Courville. NO: Mary Alice Muncey, Alfred Lane. ABSTAIN: None.
Motion approved, 7-2-0.
Phil noted this will be effective when the Portland Area Office
opens. Judy just received approval from IHS to move the CHN posi­
tion to Portland. The Springfield CHR will be given a 30-day notice.
A discussion was held on the F.Y. 1987 Tribal Council/Tribal
Govfernment budgets. Actual budget totals, including maintenance
and HIP Committee, are $526,000. Council agreed to keep their
budget within $455,000. A discussion was held on what could be
cut. Committees were asked to resubmit their budget for travel to
committee meetings only. It was decided that Council would be
provided with copies of Bud Lane and Delores Pigsley's projected
cuts, and add their own cuts to the budget. This would be reviewed
at the December 20th Regular Council Meeting.
TRAVEL REQUESTS — Art Bensell requested travel approval for at­
tending the funeral of Lewis Alexander as a representative of the
Tribe. Council agreed there was a need to establish a policy for
representatives.
MOTION #9 — Dolly Fisher moved to approve travel for Art Bensell
to attend the funeral of Lewis Alexander. Seconded by Mary Alice
Muncey. Discussion held. A policy needs to be established for tribal
representatives. If we receive a request it needs to go through thé
Tribal Chairman or Vice-Chairman. Doug felt it would be okay if the
Tribe was requested to send a representative. Normally, it would be
someone who knew the deceased. YES: Bud Lane, Lori Johnson,
Rank Simmons, Delores Pigsley, Douglas Brown, Dolly Fisher, Alta
Courville. NO: None. ABSTAIN: Art Bensell, Mary Alice Muncey.
Motion approved, 7-0-2.
It was agreed that authorization would be approved within the
State of Oregon.

Judy John requested travel to attend the Health Board workshop
on December 16 - 17 in Tacoma, Washington on Drug/Alcohol
monies.
MOTION #10 — Dolly Fisher moved to approve out-of-state travel
for Judy John to attend the Health Board Workshop on December
16 - 17, 1986, in Tacoma, Washington. Seconded by Delores •
Pigsley. Motion approved, 8-0-0.
ANNOUNCEMENTS — Dee read a letter forwarded by Bob Tom
from Mary Nevins requesting support for Dr. Raymond Leatham on
the Commission on Indian Services Board. No action was taken.
Council agreed to donate $50 towards a g ift for Governor Atiyeh's
retirement. Tina will call and get details. Jack Muschamp requested
a loan to get an eye operation. Council did not agree to this but sug­
gested Jack contact IHS for assistance. Salem Area Office re­
quested 2 salmon, 4 roasts and 4 packages of hamburger to provide
dinner for elders. This should last them until April. Council approv­
ed this request.
