On Curry County;
Beginning w ith this issue there
will be run, from tim e to tim e,
random notes on the history of
C urry County from the accum u
lation of M. S. Brainard. They
have been gathered from m any
sources "fo r some 20 y e a ts and
have been keyed so their origin
can be traced. B rainard’s collec
tion of data, system atically a r
ranged, is willed to the Oregon
Historical Society. He welcomes
any additional m aterial, in any
form, either on loan or otherw ise.

Daniel and M. ,O’C. Murphy, 1857.,
Twp. 33, R.15W., "The town of
Port Orford, county seat of C urry
County, is situated near the
northern boundary o f Sections 4
and 5.
It contains about 28
houses and a population of about
18. There are four drygoods and
grocery stores, one drug store, one
hotel, one billiard saloon and post
office, and one dram shop. The
town has very little trade; being
solely dependent upon the ‘gold
mines, distant about 27 miles in
a northeasterly direction. The
l'_ S. Mail steam er touches here
about semimonthly, for the mails,
when th e . w eather Ms favorable.
During the prevelence of - the
south and southeast winds it can
not stop. The U. S. M ilitary g ar
rison adjoins the town on the
northwest but is now abandoned.”
The same surveyors, sam e year,
write of the township roughly in
cluded between the Geisel Monu
ment, mouth of Libby creek,
Signal Butte, and the Gold Beach
school, "There have been a num
ber of settlers in this township
previous to the Indian w ars but
their habitations and improve
ments have all been destroyed.”

The^ Oregon sta te departm ent
of a g ric u ltu re is calling atten tio n
of property owners or operators
th a t Oregon law establishes the
m anner in which estray anim als
shall be handled.
W ithin five days of the appear
ance of an estray, the departm ent
m ust be notified in w riting, the
notice to be sent to the h eadquar
ters at Salem .'- The departm ent
is charged w ith trying to estab
lish identity, through its brand
records, of anim als th a t have
strayed. Failing this, the d e p a rt
m ent publishes notice of the ta k
ing of an estray and date and
tim e for sale at public auction.
R anchers or others taking up
estrays have no legal authority
to advertise this fact, but instead
should notify the departm ent
w ithin the five-day period.
Also, some confusion exists as
tc w hat an estray is. To quote
the law, an estray is "any bovine
anim al, horse or m ule of any un
known owner unlaw fully running
at large or law fully running at
large trespassing w ithin a legal
enclosure” , An anim al running
at large is not legally an estray
unless it is picked up in a live
stock control district. And the
law fu rth e r stipulates th at from
April through November, no es
tray may be taken up unless it is
unlaw fully running at large.
From a practical standpoint,
then, w here there is a livestock
control district any anim al of un
known ownership is an estray any
time. But w here th ere is no such
control district, bnly from De
cem ber through M arch may such
an anim al be considered an
estray.
