Merchants cautioned about law
by JACK Z IM M E R M A N

stale.**
The law. patterned largely
after a similar two-year-old
statue in the state of
Washington, permits retail
victims of shoplifters to seek
damages and penalties from
shoplifters
• The new law is not a
substitute for crim in a l
prosecution.' Wilson said
The criminal law still exists
and remains another weapon
against shoplifting
The reason for seeking the
new civil law, he said, is
because for many valid
reasons
the
crim inal
procedure was not suf
ficiently effective by itself
Experience in eight other
states led ORC and Oregon
lawmakers to agree the new
civil procedire is necessary
if the crime is to be curtailed

trolled
‘ Many
people
don’t
comprehend the difierence
between criminal and d v il
legal procedures, ' Wilson
said, “and that is the first
hurdle we must overcome in
educating merchants '
Merchants must still ap
prehend
shoplifters,
call
police to make an arrest and
make charges against the
individuals involved
“This much of the process
is identical whether criminal
or civil procedures are in
volved." Wilson said
Once uese steps have beer
takon criminal proceedings
are
brought
by
local
prosecuting
authorities
Local authorities general»?
have been reluctant to
p ro s e c u te ,
h o w e v e r.
Reasons may range from the
\l
many applications of it that
have been time-tested ui
other stales Far instance,
we recommend waiting 24
hours after a shoplifter is
charged before sending the
first demand letter There
are tune schedules to be
followed regarding
the
second letter and small
claims action Wording of the
letters is important
sue of the theft involved,
overcrowded eoirt dockets
or a volume of more serious
crimes
“ In other words.” Wilson
said,
“existing
crumnal
statues haven't provided the
certainty of punishment so
important, if the crime of
shoplifting
is
to
be
discouraged "
The new civil procedure —
properly
u tilized ,
can
provide certainty that ap
propriate
consequences
await those who steal from
stores
It permits merchants to
send a demand letter to a
shoplifter asking payment of
actual damages < equal to the
retail value of the goods in
question! and an additional
penalty of 1100 to $250
Amounts of damages and
the initial penalty may vary
in every case, according to
Wilson, depending on the cost
of the merchandise
Also key factors are
whether it is recovered and
age of the shoplifter
If a merchant receives no
response from, the demand
letter, he sends a second. If
that request also is ignored,
the snopiifter can be lanen to
«tnw 11 claims court.
“ Major reason for enact
ing
this
new
civil
procedure." Wilson said, “is
to prevent crime. It is not
meant to be used to harrass
the innocent or to alienate
anyone
“ And it must be used
properly to achieve proper
results ”
The Retail Council has
published m a te ria l that
explains proper utilization of
the new law and is con
ducting workshops with local
chambers
upon request
Wilson said ORC is com
mitted to this program, as
long as the need exists
While the law appears
simple." he said, “there are

That appears the position

against shoplifters
Introduced at the request
of ORC, the bill passed
during the 1979 regular

adequacy of the law itself.'
answers Otto J Wilson, ORC
director
