The Damascus

months,
r awaiting a Circuit Court of
Appeals ruling on whether the
school is operating legally.
O riginally filed last year, the
suit alleges that the school does
not meet site-size requirements
of the county comprehensive
“ The school is currently in
session,”
Kob,egarde said
Monday. “ The county did file
another suit trying to close us

pending the exhaustion of our
legal remedies.”
“ The lawsuit to close us down

The school has an enrollment
of 150 students, with about 50 in
the pre-school program and 100
in grades one through 11, ac
cording to P rin c ip a l Tim
Oakley.
Keith Kinsman, Clackamas
County counsel, said the county
close the school, but that
lawsuit is awaiting the outcome
of the school’s appeal of last
year's decision.
In Nov 1976, Judge Blanding
ruled that the commissioners
had “ reasonable evidence” to
deny the school a conditional
use permit to operate.
That decision is the one

on
appeal.
Arguments were heard last
August with a decision from the
appeals court expected within
days.
