The problem arose beeause Smith did not own taxable real property ar the tim e his election to a «econd term . He did own property when he was elec—d in 1960, but «old it about midway through hi« first term. The c ity charter states that a candidate must qualify, in a ll respects, at the tim e of his elec tion. Qualifications are that a candidate for elective o f f i c e m urt be a legal voter o f t h e State of Oregon, registered in Curry county and own taxable real property in the c ity at the ttm e of his election. The owner- Paper Box Swiped The sh e riff’s office Is In vestigating the theft of a news paper rack from the Langlois Market early Saturday morning. Th»- sheriff’ s office was c a ll ed shortly after 12 midnight by store owners, Mr. and Mrs. Ray Boston, whose son, Lannie, surprised the thieves as he was returning home. The youth said the thieves fled In their car taking one of two paper racks with them. He followed them to Dick's Farm Store where they parked back In shadows at the side of the building. Young Boston watched them for a few minutes then went back to the store and »»alted. They soon came back driving south, Boston said, and the authorities were notified. Deputy Sheriff Ira Delamar- te r recovered two newspapers found In the parking area at the side of the store and the rack was found later up the Floras Creek Road.
