To Silt' State OH tu;?;;;:;:;;;*:«}»;»*»;;»»; Number 41. 1 A CLEAR CUT ISSUE Our attention is again directed to the dock option matter by an item appearing in an exchange which is reprinted on this page. A clear cut understanding of the matter shows than on August 21, 1927, an option was given the Inman Lumber & Development Com­ pany on the dock upon the payment of $2500, which amout was one-fourth of the total amount of the first annual payment specified in the option; that 90 days time was given the company in which to make the bal­ ance of the first payment and examine abstract; that the Port Commission prepared abstract of title to the property and tendered it to the company within that period, but that the company did not avail itself of the opportunity for the reason that the Powers-Dix in­ junction suit against the Port District had been filed in the meantime; that the injunction suit held the matter in abeyance until same was decided by the Su­ preme Court in November, 1929, at which time the Commission informed the company it \vas in position to carry out its agreement to sell; that the company was unable to carry out the option owing to its own disability; that as a result of the receivership of the company, its assets, including the option in question, were sold by the receiver to one H. N. Sperry, trustee, in November, 1930; that the purchaser made no effort to carry out the terms of the option after he acquired it; that on April 5,1931, the Port Commission adopted a resolution giving the holder of the option until July 14, 1931, in which to pay all arrearages, with accrued interest, else the contract would be cancelled; that July 14th passed without compliance with the Com­ mission’s order; and that on July 25, 1931, the option was filed of record in the office of the County Clerk at Gold Reach. The placing of the option of record is a definite and clean cut expression of defiance to the will of the taxpayers as expressed through their commissioners on April 5, 1931, and has placed a cloud on the title to the district’s property which can only be removed by a court decree. The »issue ha? been raised in a clear cut manner, and the district has but one recourse— foreclosure proceedings to clear the title to its proper­ ty. Such proceeding must be taken eventually, and, as the situation is working against the best interest of the taxpayers and the community as a whole, no good reason appears to exist why action should not be taken promptly.
