The Council held the public hearing and moved to consideration of the appeal; newly seated Councilor Cleve Rooper requested additional time to review the voluminous record. Councilors agreed to continue consideration until Friday, February 10th at 10:00 am. After discussion at the special meeting on Friday morning, Councilors, by a 5:0 vote, tentatively denied the subdivi­ sion application. Final findings in support of Council's decision to deny the request will be considered at the March 7 Council meeting. (A) .MunicipalMemo ♦Adopted an ordinance which clari­ fies the requirements for release of an impounded vehicle. ♦ Heard a proposal by Fred Wessinger to purchase portions of the proposed Chapman Point subdivision and trans­ fer the property to the City of Cannon Beach. Councilors indicated they wished to pursue the proposal made by Wessinger. (D) ♦Directed staff to schedule a public hearing at a future Council meeting to gather additional testimony regarding the City's ordinance requiring the dis­ persal of duplexes and making provi­ sions for accessory dwelling units. The public hearing will likely be scheduled for the April 11 Council meeting. ♦A dopted final findings of fact in the appeal filed by David Brands to overturn the decision of the Planning Commission and deny a setback reduction in conjunction with the addition of a third story to the Surtsand Resort Motel. C ITY AND C A VENHA M W O R K TO G ETHER At the February 7 meeting, Councilors received a report by Frank Little on the C ity's ongoing d iscussions with Cavenham Forest Industries. Little reported that City representatives Little, Ron Logan, Paul Visher and Kirk Anderson have been meeting monthly with Cavenham representatives since last summ er in an effort to foster understanding of Cavenham's forest practices and encourage protection of Cannon Beach's watershed areas. Little said the city committee would like to report to the community on a quar­ terly basis so interested persons will be aware of the relationship between the city and Cavenham and under­ stand the issues under discussion Little stated that the city representa­ tives have visited all Cavenham sites within the Cannon Beach watershed a re a an d h ave p o in te d out to C aven h am representatives some tim ber harvest practices that the C a n n o n B each re p re s e n ta tiv e s consider to be unsightly. Little stated that Cavenham is trying to respond to this information and has also been very helpful in keep ing the city informed where Cavenham will be conducting harvesting or burning within the city's viewscape He said that Cavenham is developing baseline information for monitoring of Ecola Creek and the city may be able to coordinate its monitoring with that performed by Cavenham to provide a consolidated monitoring picture Little said the group has begun discussions with Cavenham about their use of chemicals and spraying and. in the future, discussions will focus on habi­ tat biology and the potential for limited access for recreational purposes to Cavenham lands. P hone - <5O3)43&2ooo Eax - (503)436-0746 MEETING HIGHLIGHTS PLANN IN G C O M M ISSIO N JA N U A R Y 15 ♦R e-elected Ron Crowe as Chairman and Bud Kramer as Vice Chairman of Planning Commission for 1995. ♦H eld a public hearing on the Scanlan Kemper Bard Companies' application for text amendments to the Subdivi­ sion Ordinance and Zoning Ordinance to permit the establishment of ocean- front setbacks for all oceanfront lots in a new subdivision as part of the subdi­ vision approval process. Presently, oceanfront setbacks would be estab­ lished in a new subdivision on a lot-by- lot basis as purchasers of individual lots applied for building permits. After the public hearing, the Planning Com­ mission determined to recommend approval of the request to the City Council. The matter will be the subject of a public hearing at the March 7 City Council meeting. (F) ♦O p en ed a public hearing on the Scanlan Kemper Bard Companies' application for tentative plat approval of a 19 lot subdivision, known as the Chapman Point Subdivision, on 36 acres of property owned by the estate of John Yeon. The hearing was continued to a special meeting on February 8. (F) ♦H eld a public hearing on an applica­ tion by Bud TerHar for off-street park­ ing variances in conjunction with the proposed conversion of the present fire station to retail space. At the request of a party to the hearing, the record was held open for seven days to receive additional testimony. The Plan­ ning Commission held the matter over until the February 8 special meeting. (G) ♦H eld a public hearing on an after-the- fact setback reduction request by Earl Twietmeyer for property located at 447 N. Larch. The Planning Commission had granted a setback reduction, with specified conditions, to Mr Twietmeyer in February 1993 to make the second story ot a nonconforming garage usable as a studio. Subsequent to that building activity, an adjoining property owner notified the City that the construction that had taken place on the garage did not appear to be consis­ tent with the plans approved by the Planning Commission as part of the setback reduction. The city s building official confirmed that the re m o d e le d second story of the garage is higher than approved and a condition requir­ ing Twietmeyer to obtain an easement from the neighboring property owner had not been met; therefore, an after- the-fact setback reduction approval UJhot has destroyed every previous civilization has been the tendency to the unequal distribution of wealth and power. PLANNING CO M M ISSION SPEC IA L MEETING FEBRUARY 8 ♦Re-opened a public hearing on the Scanlan Kemper Bard Companies’ application tor a 19 lot subdivision on a 36 acre parcel of land owned by the estate of John Yeon. During lengthy public testimony, there was a request for the record to be held open for additional submissions for seven days. The subdivision request will be sched­ uled for the February 23 Planning Com­ mission meeting with public testimony restricted to issues regarding proposed road access to the subdivision. (F) ♦ Considered a request from Bud TerHar to hold over consideration of his requests for oft-street parking variances related to the present fire station on Spruce Street until the City Council has taken action on the proposed amendments to the down­ town C1 zone parking requirements. Planning Commissioners agree to continue TerHaTs request. The Coun­ cil will hold a public hearing on the downtown parking amendments at the March 7 Council meeting.
