Williams reported that while
extending the union contracts, the city
was able to negotiate a cap on cost-ot
living increases and increased health
benefit costs. An additional effect of this
action was to avoid the costs generally
incurred in the negotiation process which
requires City Manager and City Attorney
time. Council formally took action to
accept the negotiated contracts and to
include the 6% retirement contribution
pickup in agreements with the city s six
non-union employees.

♦ Held a public hearing and adopted an
ordinance to amend the text ot the Zoning
Ordinance to allow vinyl siding to be used
on manufactured dwellings; currently
the Ordinance permits wood siding only.
♦ Held public hearings on requests from
Ron Logan to have a 25 acre parcel of
land w ithdraw n from spe cia l taxing
districts when the parcel is brought into
the Cannon Beach city limits. Council
approved requests to remove the proper­
ty from the 4-H and Extension Service
district, Road District #1 and the Sunset
Empire Park and Recreation special
taxing districts. (A)
♦ Considered a request by David and
Julie Brands to hold a de novo (new
hearing with new evidence and testimony
admitted) on their appeal of the Planning
Commission's approval of a setback
reduction requested by Steve Martin in
conjunction with the addition of a third
story to the Surfsand Motel. (C) Council
determined that the Brands request for a
de novo hearing did not meet the criteria
established in the Municipal Code so the
de novo request was denied. The appeal
will be heard at Council's January 3
meeting, based on the record established
by the Planning Commission; no new
evidence will be permitted
♦ Tentatively approved a proposal to
amend the Zoning Ordinance to add a
section concerning permitted materials
in required frontyards in residential zones.
S ta ff w as d ire c te d to p re p a re an
ordinance for consideration at the next
Council meeting. The intent ot the
proposal is to encourage property own­
ers to provide living landscape materials
in the required front yard area rather than
paving or gravelling the entire yard. The
ordinance will be considered at Council's
January 3,1995 meeting.
♦ Approved resolutions stating the city's
intent to proceed with sidewalk improve­
ments on the south side of Sunset. Blvd
between Hemlock and Spruce Streets.
Council had tentatively approved a rec
cmmendation of the Public Works Com­
mittee last August to proceed with the
development of sidewalks on Sunset Blvd
from Hemlock Street east under the over­
pass and around to Elk Creek Road. (D)
♦ Made the following appointments to
City committees:
Parks and Community Services Com­
mittee for three year terms: Barbara
Gray, Tom Merrell and Ann Kramer.
♦Council appointed Bud Kramer as one
of the city 's representatives on the Clatsop
Economic Development Council (CEDC);
Frank Little will continue to serve as the
city's other representative to CEDC.
Design Review Board for three year
terms: Victor Plucy and Heather Webb.
Public Works Committee for a three
year term: George Walker.
Energy Com m ittee for three year
terms: Jerome Arnold and LeonCieloha.

♦Accepted a report from the Short Term
Rental Review Committee and referred
the report to the Planning Commission
for action since amendments to the
Zoning Ordinance will be required to
implement the Committee's recommen­

following recommendations to Council
regarding the city's licensed short term
rental dwellings:

♦ Held a public hearing on the City of
Cannon Beach application for an amend­
ment to the Municipal Code section of the
Limited Commercial (C1) zone standards
to establish off-street parking standards
in a defined dow ntow n com m ercial
district. Based on the testimony received,
the Planning Commission referred the
proposal back for another work session.

♦ Council received additional informa­
tion on raccoons, provided by the Code
E nforcem ent O fficer in response to
several citizens complaints regarding
raccoon/people encounters and properly
damage. Council agreed to direct staff to
implement two of the Code Enforcement
Officer's recommendations: to make a
written “complaint form" available at City
Hall to track the problem and to send a
letter to all property owners regarding the
inadvisability of feeding raccoons and
making property owners aware of some
of the raccoon-related problems that have
occurred in Cannon Beach.
♦ Jo h n Williams reported that Council
has held two executive sessions to
discuss the potential effects of ballot
measure 8 and has tentatively determined
to extend the union contracts for city
employees through June 1997. This
action extends the period of time in which
the city will continue to pay the 6%
em ployee share of contribution to a
retirement plan while litigation regarding
ballot Measure 8 is being settled in the

♦ The Planning Commission took public
comment on the draft Parking and Traffic
Management Plan for 1994 95 and will
recommend approval of the updated plan
to City Council.
♦ Held a public hearing on the City of
Cannon Beach request for an amend­
ment to the Municipal Code section on
microwave receiving dishes to exclude
dishes with a diameter of 30 inches or
less from the requirements of the Code.
The Planning Commission will recom­
mend approval of the amendment to the
City Council. If adopted by Council, the
change will permit the installation of the
new small microwave receiving dishes
which are replacing the very large satel­
lite dishes previously required for satel-
lite cable television reception. Theamend
ment will be considered at Council's Jan­
uary 3,1 995 meeting.
♦ Did not adopt final findings of fact,
conclusions and orders denying Sub 94-
02, Holland request for tentative plan
approval for the Holland addition, a
proposed 11 lot subdivision to be created
from a 4.04 Acre parcel of land located

The City Council held a worksession to
review the mission and activities of the
Parks and Community Services Commit­
tee, the Public Works Committee and the
Energy Committee. The chairmen of
each of the committees responded to
Council questions and discussed com­
mittee goals and accomplishments.

ty Presbyterian Church application for a
conditional use to permit expansion ofthe
church located at 132 E. Washington
Street. The applicant is also proposing to
remove the existing dwelling located at
172 E. Washington and develop the area
as additional off-street parking. The
applicant requested two variances in
conjunction with the expansion: V 94-06
requests a lot coverage of 73.5% where
the Municipal Code permits a lot cover
age not exceeding 50% and OSP 94-02
requests 47 feet of access onto Washing­
ton S tre e t in co n ju n ctio n w ith the
proposed parking lot where the Municipal
Code provides that access is limited to a
maximum width of 24 feet. The Planning
Commission determined that 55 off-street
parking spaces are required for the
expanded church; granted the Off-Street
Parking variance request; granted the
request for variance from the lot cover­
age requirements and granted the Condi­
tional Use request to permit expansion of

♦ Held a public hearing on Steve Martin

setback reduction and off-street parking
variance in conjunction with the proposed
rem odelof the Wayfarer Restaurant. The
proposed remodel would increase the
existing first floor restaurant space by
1600 square feet and add a second story
to provide a 3400 square foot meeting
room/banquet facility. The W ayfarer
Restaurant is located at 1190 Pacific Drive
in an RM, Residential/Motel, zone. The
applicant requests a setback reduction to
permit a 7.9 toot setback adjacent to
Ecola Ramp Approach Road; the restau­
rant is presently non-conforming in its
location 7.9 feet from Ecola Ramp where
a 15 foot setback is required. In conjunc­
tion with the reconfiguration of the
e x is tin g p a rk in g lo t, the P la n n in g
Commission approved an off-street park­
ing variance to permit 47 feet of access
onto Pacific Drive. The setback reduction
and conditional use requests were also
