(Continued from page 3) LUBA to pay the amount, said City Attorney Patrick Kelly because “it was a worthless appeal.” He further characterized it as “officious intervention” and “a falla- cious argument.” Sommer read a “press release” regarding the matter. He first gave the check to Fiske, who is council presi- dent, indicating that he did not want to give the check to the mayor because of his stance on the appeal. Sommer had appealed a city decision approving an annexation. His position is that because the city could not provide essential services, such as law enforcement, the annexation should not have been approved. LUBA denied his appeal, and ordered him to pay the city’s legal fees. Monday night, the mayor and council voted 5-0 to also seek compensation for Som- mer’s second appeal to LUBA. As part of his state- ment in presenting the check, Sommer urged the council to not pay Kelly and to dismiss him. He stated that Kelly has a vendetta against him. In subsequent commen- tary of some length, Kelly stated, “I don’t care enough about him to have a ven- detta.” He also took strong issue with Sommer’s remark that he (Sommer) holds the city responsible for the death of former mayor Tom Green, who was the victim of a homicide on Dec. 10, 2007 in front of his home. Sommer said that it’s the city’s fault because of not providing adequate law en- forcement. Fervent refutation came from the mayor, noting that there were many factors involved, including the fact that Green chose to not file charges when his attacker harmed him during earlier incidents. Green operated Tom’s Home, providing shelter for various youths. Also contest- ing Sommer’s comment was Josephine County Sheriff Gil Gilbertson. He stood and called the accusation “in poor taste.” In presenting the check for legal fees, Sommer im- plied that he wanted it to be a donation toward law enforce- ment. Kelly disputed that statement, saying that there is a difference between paying a legal fee and making a dona- tion, and that Sommer knows the difference. After the city attorney’s remarks, Sommer attempted to speak again, but was squashed by the mayor. Som- mer said that he should be allowed to respond to Kelly’s observations because, he claimed, they constituted a personal attack on him. Paulson told him to sit down and hold his comments, and Sommer complied. Tuesday morn- ing, July 15, following a sin- gle-vehicle accident which demolished a utility pole at Hwy. 199 and Krauss Lane. Illinois Valley Fire District (IVFD) responded to the 5:31 a.m. alarm. The driver of the pickup truck, believed to be from Brookings, was trans- ported by American Medical Response. Pacific Power responded and had service restored by approximately 7:45 a.m. Oregon State Police also responded, and IVFD tempo- rarily closed the highway to big rigs due to low-hanging telephone lines, although trucks were rerouted with little delay.
