Page 4 Illinois Valley News, Cave Junction, OR Wednesday, January 9, 2008 Ruling might open federal purse strings By CURRY COASTAL PILOT, BROOKINGS A recent U.S. Supreme Court ruling could result in the 18 Oregon O&C counties receiving adequate funding, according to Marlyn Schafer, chairman of the Curry County Board of Commissioners. The court ruling came in the case of the National Asso- ciation of Homebuilders vs. Defenders of Wildlife. “It says endangered spe- cies legislation does not supersede any existing legisla- tion,” said Schafer. “It came down in September, but it was the end of November” before it became generally known. “For the O&C counties, this is huge,” said Schafer. “It means (that environmental- ists) can’t file lawsuits against BLM. It will probably allow BLM to go ahead with plan- ning. That’s a huge thing.” Schafer, recently elected to the Association of O&C Counties Board of Directors, said that the board soon will discuss court ruling. “I think that’s absolutely the one thing that might save us,” she said. “It says the En- dangered Species Act (ESA) does not trump previous leg- islation. This is our real hope. “It could force the en- forcement of the O&C laws.” She said that since 1937, it has been the law that BLM would manage the O&C land to benefit counties. “We would get 75 percent of the revenue,” she said, adding: “When the ESA hit, the courts were allowing lawsuits that said everything had to comply with the ESA. Basi- cally, it stopped all logging. “BLM was told to man- age for species instead of logging.” Schafer said that the new Supreme Court ruling means that even though the ESA has been approved, the O&C counties legislation was there first and takes precedence. She said that it probably would be four years before the counties would begin re- ceiving money from renewed logging. Meanwhile, she said, the counties need the Secure Rural School Safety Net funding from Congress that failed during December. *** The O&C land consists of the remaining parcels originally granted to the O&C Railroad Co. in 1868 to build a line from Portland to the Oregon-California border. Because the railroad did not meet the grant require- ments, the federal govern- ment took the remaining land back in 1916. These lands are managed by BLM. In 1937, Congress passed the O&C Sustained Yield Act. When land is in federal ownership, there can be no property taxes applied nor can it be developed commer- cially or for industrial pur- poses. The O&C Act was passed so that counties would receive shared revenue when timber on these lands was sold. Timber production on these lands has been reduced by considerably more than 90 percent since the listing of the spotted owl in 1990. To protect the O&C counties from insolvency, the federal government has passed a series of Safety Net payments to replace the tim- ber revenue. A private family service will be held. She enjoyed an extra- special Christmas with her husband and children, thanks to the generosity of many Illinois Valley residents and Provi- dence Hospice of Medford. “Erin” was born Erin Kay Lunt on Aug. 13, 1979 in Long Beach, Calif. In 1983 she moved with her family to Selma. On June 1, 1997 she married Kevin Vineyard, who survives. She worked at Select Market, and Wild River Brew- ing & Pizza Co.; and most recently at Speedy Mart. She had many friends. Her family said that “Erin” was known as a special person who will be greatly missed. “Erin” is survived by her husband, Kevin; their two sons, Zak and Jon, all of Cave Junction; her mother, Kathy Smith, of England; her father, John Lunt, and his wife, Jenni- fer, of Selma; two sisters, Kasey Lunt, of Cave Junction, and Trina Cook, of Grants Pass; a brother, Josh Lunt, of Moscow, Idaho; a stepsister, Jill, of Selma; paternal grandfa- ther, Phillip Lunt, of Cave Junction; and relatives includ- ing nieces, nephews, cousins, and aunts. She worked in Australia as a telephone operator for several years. Later while working as a motel receptionist she met and married Harold Brown in Durbin, South Africa. Following his work, to- gether they traveled the world and lived in many places in- cluding Mozambique, Africa, Singapore, Borneo, Perth, Aus- tralia, and The Philippines. They moved from California to O’Brien where they made their home 27 years ago. She was known as an ex- cellent cook and a good friend to her neighbors. She enjoyed gardening and traveling. She is survived by her husband, Harold Brown; and a stepson, Eddie Brown, both of O’Brien; three sisters, Patricia, Margaret, and Annette; and a brother, Fred, all of Australia; and several nieces and neph- ews. Honoring his request, his family will not hold a service. Mr. Cherry was born in Gray County, Texas July 8, 1917. He moved to Medford with his family in 1925. They had a ranch on Griffin Creek. He attended schools in Rogue Valley, and graduated from what is now South Medford High, where he met his future wife, Virginia Huber. They were married June 20, 1938 in Los Angeles. The couple made their home in Medford for many years, and in 1953 he moved the family to Illinois Valley to continue his long career in the lumber industry. In 1995, after several years of retirement, they moved back to Medford. Mr. Cherry is survived by a son, Ronald Cherry; daugh- ter, Pamela Cherry; seven grandchildren and nine great- grandchildren. His wife, Gin- ger, died on Nov. 10, 2007. Arrangements were by Perl Funeral Home, of Med- ford. Cremation was planned.
